MiWay Admits Their Driver Broke Multiple Road Laws – Still Refusing to Pay

I am posting this to warn others about how MiWay handles claims.

I was involved in an accident at a T-junction in a 40 km/h residential area. I had indicated and was safely executing a right-hand turn, with a vehicle behind me slowing down. An independent eyewitness was also present at the junction, and I provided both **video evidence** and the **eyewitness driver’s contact details** to MiWay.

After reviewing everything, MiWay themselves confirmed that their insured driver:

* Was speeding in a residential 40 km/h zone * Overtook multiple vehicles * Did so at/near a T-junction (which is ******* and extremely dangerous) * Failed to keep a proper lookout

In other words, their driver broke multiple road rules and created a reckless, ******** situation.

Despite this, MiWay is still refusing to settle my claim fairly.

They claim their driver is “predominantly at fault,” yet they are trying to shift 20% of the blame onto me — simply because I was turning right. This makes no sense, as no reasonable driver can anticipate someone speeding and overtaking cars at an intersection.

The collision was severe enough to hit my driver’s side door, putting my life at risk. This has left me not only with vehicle damage but also ongoing trauma — I am still not comfortable driving or even being a passenger.

MiWay then states that even with an 80/20 split in my favour, there is “no payout.” How can a driver who broke multiple laws and caused a serious accident result in zero compensation?

This feels like an attempt to avoid liability despite clear evidence.

I have:

* Video proof of the incident * An independent eyewitness confirming events * MiWay’s own admission of their client’s reckless and ******** driving

Yet I am still being denied a fair outcome.

I am asking MiWay to:

* Take full accountability for their insured’s actions * Reassess this claim fairly based on the evidence * Provide a reasonable payout

Consumers deserve better than this.

I hope MiWay addresses this urgently.
