Miway 3rd - Party claimant, in the dark, excluded and an offer with no resolve (Motorcycle Still Damaged & Standing)
<p>On the 29th of August 2016 my stationary 2 ********** s Suzuki Bandit motorcycle was reversed over by a Miway client. I contacted Miway regarding what is the protocol regarding a 3rd party claim, they stipulated to me the required documentation needed and a part of it was a repair quote.</p> <p>I towed the bike to the agent where I received a R33000 quote to fix the bike back to its original condition. After close to three weeks of deliberation, arguments and being in the dark, as I had to call every time to find out what the process is, multiple resubmissions of documentation, constantly on hold or staff whom i need to contact not answering their phones. I finally found out that an assessor had seen my bike and had not contacted me to understand my needs.</p> <p>Finally the assessor came back and a settlement offer had been on the table for and absurd R17280. When being on the phone for almost an entire day with multiple people in the Claims and Legal departments i was told that the amounts are calculated based on the bike value, and they decided to s**** my bike and pay me out a percentage based on Miways calculations and protocol. The reassessment was +-R22000 and that was for a respray and replacement parts. You need to understand that this bike was in mint condition. Why would I want a resprayed replacement part bike? I want all the components replaced so the bike can be in its original condition.</p> <p>What if this bike was a 1920 Harley? What book value would there be? None. If this scenario played out compensation would still be required based on the third party claimed need not a basic calculation writing off peoples assets. I called the agent who is repairing the bike and he says the bike is not a write off and can be repaired and it mostly cosmetic damages.</p> <p> </p> <p>Not once was I called to hear my needs</p> <p>I was never contacted to discuss what the damages where. I had to make daily calls from the 29th August 2016 to 20th September 2016 to get feedback.</p> <p>I never agreed to Miways policies and calculation procedures.</p> <p>No one spoke to me regarding the write off. (This bikes damage is mostly cosmetic)</p> <p> </p> <p>As far as I’m concerned I should be compensated to repair my bike back to its original condition. Covered fully under the Miways policies under their client. Under the current protocols I can’t even fix my bike. Each time I call Miway legal I’m told, “that’s the way it is” and no one will hear my side of the story or attempt to renegotiate. No one picks up the phone to discuss this matter with me, why? Why am I excluded from the decision making process where perhaps id like my voice heard regarding my assets?</p> <p> </p> <p>So now I’m left with a damaged bike I cannot repair with a ridiculous settlement offer. Irrespective of bike age, my bike was damaged and I should be fully compensated to repair this bike back to its original condition not smothered with legal jargon and calculation protocols which I never agreed to in the first place.</p> <p> </p> <p>As a current Miway client (with a different vehicle) I’m flabbergasted at how this process has occurred, and how I’ve been steam rolled into a corner. I find this absolutely unacceptable!</p> <p> </p> <p>I would like feedback on how this offer can be renegotiated with someone with who understands Motorcycles and people’s needs.</p>

I called Michelle and Marietjie in that department they advised me to speak to their Manager Madeleine V. I’ve called Madeleine prior to and on the 16th, 19th and yesterday the 20th of September where no one picks up their phones. I’ve emailed Madeleine 20th Sept and I still await a response or a call back.
Why should I be so aggressive to have a discussion? Why am I constantly following up. I should be contacted do discuss this matter. I feel have been more than accommodating, however I’m still left unassisted. None of these “formalities” will repair my bike. Can anyone tell me how my bike is going to be repaired? Miways client won’t cover costs? Miway won’t even cover the costs of a basic repair? My bikes standing and has not been touched since the day 29th August 2016. How does this help me? No one can answer because they hide behind protocol and won’t listen to common sense!
