Mi way third party claim

Hi

So basically I was in a car accident with a Mi way customer I am the third party claiming, I do not have insurance. (It was not my fault for the accident)

I sent Miway clear video foutage of the incident, one of the residence has a camera facing the, i was in luck.

I sent them all the required documents they requested.

The accident happened the 5th August 2023. The person who I am corresponding with ia Sam Gumbi.

I even had to appoint an attorney to assist through this process to back ME from this point onwards.

What I need to confirm is how long is the process going to take as i only have one car. You have clear video foutage . please gEt back to me ASAP

So I receieved a call back from Sam, what she said was" although the driver drove over the stop street they watched the video of the incident" I had to be aware of surroundings lol. I am now handing this over to my lawyer. She said she will type out a letter explain to why they wont pay out. I will type out her explination on here. My adviCe to everybody is. Rather pay that extra R100 to R200 extra on your premium with a reputable insurance COMAPANY than to have these type of issues. Go with Santam, mutual and federals ETC. The video is clear as day light.... I will upload the video as well Sam's response to why they not payong out on all platforms and social media. Its already on my whatapp and facebook..

WOP” Good day, Hope that this mail finds you well, As per our discussion, Please be advised that upon careful analysis of the merits of how the accident happened and in consultation with our client, we find that our insured is not liable for this accident. For the following reasons: A reasonable person travelling on the road, being in control of a vehicle is expected to adhere to specific duties and responsibilities. The two most important duties of any driver are: 1. to keep a proper look-out, which includes an awareness of what is happening in his/her immediate vicinity. This will include nearing or entering an intersection such as cross roads, on-ramps and off-ramps; and2. to drive at a reasonable speed, irrespective of the speed limitation placed on the road. Whether a person was travelling at a reasonable speed will depend on the specific circumstance present at the prevailing moment. In this particular case as much our insured was coming from a stop sign, it doesn’t absolve you of the duty to keep a proper look out and be vigilant of your surroundings.Our insured had already travelled over 3 lanes when the collision happened, showing that they were already well into the intersection when you collided with their vehicle.Furthermore your damages are frontal and our damages are on the rear left, this shows that our client was actually completing their crossing of the intersection and had no way to avoid the accident as the damages are at the back, whereas your damages show that you had good visibility of what was ahead but failed to take evasive measure’s to avoid the accident. In light of the above we find that our insured is not liable and we will not settle your claim. Kind regards,
