Hidden conditions and false marketing

My brother borrowed me a car and i was involved in an accident in september 2015. The claim was approved, the car was written off and they paid the claim. When the claim was registered Miway was advised and given details of the third party. On 29 June 2017, I received a summon from the clerk of the court on behalf of the second car driver. I informed my brother who informed the insurance. I got a response from Miway rejected the claim stating that liability follows a person not the car but the car that was involved in the collision was insured with Miway. The policy schedule states that third party accidents are covered for. Please clarify whether comprehensive car insurance covers people or cars?

I was also told by Miway representative that it will be difficult because the accident happened in the streets of johannesburg not in Mokopane as this was the registered address. Does this mean insurance bounds us to travel in the same place where the car is addressed to.

The comprehensive insurance would include covering claims where a third party claims damages as a result of a motor vehicle collision.

Kindly issue a formal repudiation letter and the clauses you re**** on to repudiate the claim. This is be in line with the policy schedule received for this specific insurance.
