Disgusting claim experience
In March last year I submitted a claim to Miway after noticing apparent damage to garage walls going from plaster cracks to worse. An assessor (one Marius) was sent out. Note, checking later I cannot find any record of Marius being registered as a loss adjustor for construction/building. An assessor report was signed by one Ronald Beeby PR Eng (civil) making outlandish statements such as Randfontein is a 'notorius are for clay soils' (news to me and everyone else here. Claim rejected on this basis. Miway advised I had 30 days to appeal. I advised I'd be appealing, with details to follow. After a week, and without me submitting any detailed reasons (like building plans had been passed, no sign of clay), Miway rejected the claim. I also lodged a formal complaint with ECSA, which took the complaint seriously, sent out an engineer to inspect the damage and report back on his findings and what Mr Beeby had to say (especially as Mr Beeby did not himself visit or have a look, his report based on a few photos and Marius's comments). ECSA has looked at the matter, given parties an opportunity to respond, and I was advised last week that ECSA has formally charged Ronald Beeby on 3 counts of breeching the ECSA Code of Conduct for members. Basically he has been charged with not doing his duties with integrity, honesty or fidelity or exercising due care, skill or diligence. Quite correct, Council for Geoscience maps show no clay in this area, let alone 'notorius' amounts as one example of the complete fabrication in the report. Taking the wording of Mr Beeby;'s report in comparison to the wording of my policy (under what is not covered), wording is very similar, and given that Miway rejected an appeal without hearing any details, makes me wonder if there wasn't collusion between Miway and Mr Beeby. Just all fits far too neatly. Ombudsman wasn't interested in Miway rejecting an appeal without any info etc. Fortunately ECSA does take the matter seriously and is proceeding. Maybe others have had similar experiences with Miway and/or Ronald Beeby. They probably thought I'd just accept the rejection and leave it there. Unfotunately for them, I know there is no clay, witnessed it myself, properly inspected by municipality inspectors etc, so I wasn't going to let it go. I've had the damage fixed, at my cost. At least half of it was in fact due to a leaking water pipe in the wall (which is covered in the policy), the rest, I still don't know, but not for any reason given by Mr Beeby.
Wonder what Miway will have to say about that ? Needless to say, I've moved all my insurances, business and personal, from Miway to another insurer, and actually got a cheaper premium as well! Miway does insurance (claims) their way, not mine !
