Deformation of character and False Statement using my details

I refer to the above matter and to your letter of demand dated 6 November 2018. 2. I do not intend to respond to every allegation contained in the aforementioned letter but to the extent that I do not address a particular allegation, same should not be construed as an admission of the veracity thereof. 3. The incident to which your letter refers transpired as follows: 3.1 On or about 27 May 2018 while commuting to my place of work, the quantum minibus taxi (“quantum”) in which I was a passenger, collided with your client’s black Audi vehicle. 3.2 Immediately thereafter, the driver of the quantum then engaged in a verbal altercation with your client, the subject matter therein was largely in reference to the exact person responsible for causing the accident. 3.3 Your client having overheard my assertion that indeed the driver of the quantum was the cause of the accident, requested my cell phone number so I can be a witness to the legal proceedings that would have inevitably ensued in respect of the damages caused. 3.4 Despite my reservations, and in hindsight such reservations were well placed, I reluctantly gave your client my cell phone number for such purposes.

3.5 Approximately six (6) months thereafter and to my utter surprise and dismay, I then received your client’s letter of demand in respect of the damages caused from collision with the quantum. 3.6 It is unclear on what basis your client alleges that I am liable for the damages caused by the accident. Such accusation is without merit and factually inaccurate. 4. Without purporting to advise you, it will suffice to state that I unequivocally deny liability in respect of the damages suffered by your client to any extent whatsoever. How you were able to make that determination defies logic or reason in all respects. 5. I can only attribute your reasoning as nothing more than a woefully investigated enquiry and strongly encourage your department to exercise a greater degree of care before deciding to subrogate your client’s claim. 6. I must point out that I will be seeking legal counsel with regards to the detrimental effect of your letter of demand and will advise accordingly. 7. To that extent, kindly confirm by no later than close of business Friday 9 November 2018 whether or not you will be pursuing this matter any further. I advise that any such litigious steps will be vigorously opposed and I will be seeking a punitive costs order in this regard. 8. I trust the above is in order and await your prompt response.
