Conflicting themselves

On 23/10/15 we were crashed into on the corner of Church and Ducan. We had entered the intersection wanting to turn right. The light went orange and we waited for the car to clear the intersection and proceeded to go when we believed it was safe to do so. Before we could exit the intersection the light changed red and the client drove into the back of my car. We do not have insurance meaning this is a 3rd party claim. The client the next day at the police station stated in the police report that he was distracted and not looking at the road (I have given MiWay the case number). Now after stalling for 4 weeks MiWay tells me they will not pay out because he claims he went over an orange light and we crossed his path. First off he admitted to not looking at the road (which MiWay acknowledges) how then does he know the colour of the light. Secondly the rules of the road clearly state \You must stop on a yellow light
