Claim Rejected

Broker sold me Short Term Insurance which included Building Cover, quotation done at my home. After the wind on Saturday, 2 Assessors from Miway (NoWay) came to my home and both agree that the boundary walls are not up to SANS specifications and thereby claim is immediately rejected. I asked him to check my other boundary walls and without hesitation I was told that my Precast walls were not compliant as they are also retaining walls...UNDERSTOOD. My question is, why was I sold the insurance when it must have been obvious to the Broker as well that my Walls were not compliant and would not be covered? Is it the Brokers Fault? Perhaps, but I know that brokers are not trained, nor told to inspect "even visually" if what we are payong for is actually covered. The assessor went into details about the width of the bricks and the height of the wall and what it should be etc and told me that I should have disclosed this. How should i know these technical details, shouldn't the broker who sat at the home insured be better equipped to notice these things? I will be going to the Ombudsman regarding this matter

Is it the Brokers Fault? Perhaps, but I know that brokers are not trained, nor told to inspect "even visually" if what we are payIng for is actually covered. The assessor went into details about the width of the bricks and the height of the wall and what it should be etc and told me that I should have disclosed this. When i asked him to check the rest of the structure in the house he said it wasn't his job "he recorded our whole conversation btw". I also asked why MiWay doesnt send someone to inspect property before giving cover, he told me "inspections were only done on expensive properties as it costs over R7000 minimum per inspection 10 years ago and it doesn't make business sense for Miway. If i am expected to know these specs, then surely the trained broker should be better equipped. I will be going to the Ombudsman regarding this matter after I have followed the internal process. I would at the very least expect that the Premium paid towards Building Cover "since inception" be refunded, since the broker knew or shouldve known it wasnt compliant and since it didn't make business sense to Miway to do an inspection... Is it not strange that at cliam stage you guys are able to send 2 different individuals "one the repair company to quote, two, the Miway inspector to look for ways not to pay" but you are not willing to send ONE inspector at Inception??? MiWay "NoWay" truely looks for reaons not to pay.
