Breach of Contract
On the 28th October 2017 I lost my cellphone which was insured with miway for the amount of R11000 which also stipulates on the contract. I phoned miway on the same day but unfortunately their call centre was already closed. On the 30th I phoned and I spoke to the lady by the name Pesley(apologies if the name is incorrect) who assisted me with the claim she took all the details and promised to phone me back which she did two hours later. She told me about the R680 access that I must pay to the service provider and that I am going to get a letter/ quotation from a service provider so I can be able to buy another iPhone 6. I asked why iPhone 6 because when I went to do a sim swap the previous day a lady told me that an iPhone 6 is now R6000 SO WHY WOULD I TAKE AN IPHONE 6 WHERE IS THE OTHER R5000 GOING TO WHEN MY CELLPHONE WAS INSURED WITH R11000? she said because the value of a cellphone depreciates. nobody has ever told me that a value of a cellphone depreciates when I took a cover and the premium I have been paying is based on the cover so why would they tell me now when they have to pay? It is on my contract that my cover is R11000 NOTHING ABOUT THE DEPRECIATING OF THE VALUE. MIWAY MUST PAY ME THE R11000 AND IT IS THEIR RESPONSIBILITY TO EXPLAIN TO THEIR CLIENT BEFORE THEY FINALISE THE SALE INSTEAD OF FALSE SELLING. MIWAY MUST PAY THE R11000 TO ME
