Avoid business insurance at Miway business insurance
<p>We hereby warn all prospective UBER partners to avoid insuring their UBER cars at Miway business insurance.</p> <p> </p> <p>Miway business insurance exploit innocent young Entrepreneurs to make Miway's business profitable, they are totally missing the point of business insurance and the risk involved with insuring UBER clients. </p> <p> </p> <p>Miway business insurance used the insurance policy to find us the Members of our CC "the business insurance policy holders" at fault for not ensuring the UBER driver in Port Elizabeth did not athear to the rules of the road (we the business insurance policy holders are based in Pretoria and Johannesburg).</p> <p> </p> <p>We unsucessfully disputed the outcome of their investigation with the following facts:</p> <p> </p> <p>1. The reason for rejection was stated as “due care and precaution”</p> <p>- As per your MiWay Business Policy, due care and precaution is needed from the business insurance policyholder;</p> <p> </p> <p>- The rejection letter provides no detail as to how the said policy was app**** to our specific case (i.e. how did we, as policyholders, show lack of due care and precaution?);</p> <p> </p> <p>- It is MiWay’s finding that we, as business insurance policyholders, did not use all reasonable care and take all reasonable steps, with the same degree of carefulness which can be expected from the reasonable man on the street, to prevent or minimise loss, damage, death, injury or liability;</p> <p> </p> <p>- We wholeheartedly disagree with this statement. Firstly, MiWay never investigated our due care processes. MiWay came to this conclusion by only contacting/investigating our driver. No attempt was made to contact us before coming to the conclusion;</p> <p> </p> <p>- To enlighten MiWay, the following steps were in place from a policyholder perspective to comply with the said Business Policy:</p> <p>(a) Full disclosure of previous incidents involving our car and our driver was made to MiWay;</p> <p>(b) Full disclosure was made as to the business purpose of this vehicle (metered taxi service – Uber). This was noted in the policy document (attached);</p> <p>(c) Full disclosure of the fact that we are based in Johannesburg and this vehicle will operate on the Uber platform in Port Elizabeth;</p> <p>(c) Business Cartrack package installed, which includes live tracking. We as policyholders did a daily check to ensure the kilometers logged and charged on the Uber platform were in line with Cartrack reports;</p> <p>(d) We had a verbal agreement with our driver that the vehicle may only be used for the following purposes:</p> <p>(i) Drive from Despatch (place of residence and nighttime physical address of vehicle) to Port Elizabeth (main area of business, although Uber is not limited to Port Elizabeth only);</p> <p>(ii) Business purposes (driving clients);</p> <p>(iii) Private use if prior approval was obtained from Mr. LJ Struwig (who was the main contact between the business and the driver);</p> <p>(e) All fuel slips were immediately sent through and reconciled as to ascertain whether the vehicle was used outside of the abovementioned agreement;</p> <p>(f) Regular service intervals (as per Toyota service plan) was done and the intervals (10,000km) was used as another measure of whether the kilometers logged reconciled to the actual kilometers driven;</p> <p>(e) The driver was selected after he passed all the background screenings provided by Uber. This includes, but is not limited to:</p> <p>(i) Verification of proper license (C1);</p> <p>(ii) That he has no prior ******** record; and</p> <p>(iii) That there was no reason for Uber not to accept him as driver on the platform (due to previous incidents).</p> <p> </p> <p>2. Terms and conditions</p> <p>- The terms and conditions document applicable to our Business Insurance Policy has been requested from Anel Bornman since inception of our insurance agreement. To date this, on which the rejection is based, has not been received;</p> <p>- Cover commencement date was 6 January 2017 (as per attached); and</p> <p>- Thursday, 23 February 2017, was the first time our Policy Schedule was sent to us (their reason was that they had our incorrect email address).</p> <p> </p> <p>3. Actual events on night of accident</p> <p>- This usage (driving to Grahamstown) would immediately have been picked up in our daily reconciliation of kilometers between the Uber platform and the Cartrack usage report; and - We as business insurance policyholders can’t be held accountable for actions taken by our driver outside of our agreement. We took all reasonable steps to ensure that the vehicle is only used for its intended business purpose.</p> <p> </p> <p> </p> <p> </p> <p> </p> <p> </p>
