Appalled by this disgraceful, unacceptable rejection of my valid claim.

Dear Disputes and Complaints team.

I am writing to formally appeal the decision to reject my claim

I am extremely disappointed, frustrated, and in absolute shock regarding the manner you handled and ultimately rejected my car insurance claim. The incident occurred on 05th of July 2026 and I submitted all necessary paperwork immediately. It took your team [ 4 - Weeks: 1 Month] to provide a final outcome. This lengthy delay is entirely unacceptable. I was left stranded without clear communication for weeks. Ample time was given, where I did not interfere. I left MIWAY to do what they had to do and the outcome and reasoning received is more than shocking!!!!! Your rejection is particularly insulting because I fully comp**** with every single request from your adjusters. I submitted all requested photos and videos on time. Provided the 13th July 2026 I provided the official police report immediately. Provided the 13th July 2026 I answered every follow-up question honestly and promptly. All information was given to Waitse Setlhare ( including recordings recorded by him regarding timelines and movements by myself on Saturday the 4th July 2026 ) and we went to all relevant sites including the accident scene on the 13th July 2026 My wife ( Shereen Wadrif ID number *** ) and I have been a loyal, premium-paying customers, yet I am being treated like a hindrance rather than a client in need. I simply do not understand how a legitimate claim can be denied after I fulfilled all my obligations. I am demanding an immediate, independent review of this claim by a senior manager, the underwriters or whoever is in charge of the disputes channel. Please provide a written explanation detailing the exact policy clauses you used to justify this rejection. As no clear information has been given from start to finish - Please refer to the below as I first received a call from Waitse Setlhare 6th August 2026. Stating my claim was rejected based on " True and complete information not provided" He then asked, could his manager call me on Friday the 7th or August 2026 or Tuesday the 11th August 2026. The manager Gerhard Du Toit contacted me on the 11th August 2026 saying that the claim was rejected because - I gave my friend my bank card Saturday the 4th July 2026 and he stated I gave it to him Friday the 3rd July 2026. ( I have proof that I still had possession of my bank card on the 4th July 2026 throughout the day. Whilst my friend was in Limpopo as he stated with my bank card. This information too was shared with Waitse Setlhare, which is with him. ) A bank statement proves money left my account at a liquor store, Goldwagen and other places. This proves that I had my bank card and statements and this too was provided. A Card Transaction is not a Blood Test! It does not prove who drank the alcohol! Or if the driver was impaired. Miway is trying to claim I **** about the timelines, alcohol and more. On the 30th of July 2026, I received an email from Er Consulting CareTeam. Stating " Patient is alert and shows signs of intoxication"... " Blood samples to be taken. Patient refused blood and scans and wants to sign RHT"....... " The patient is noted as an 88-year-old male. Whereas he is born in 1988"....... What a joke!!!!!!! " Obvious deformity noted on the head in the right temporal region"....... When Gerhard Du Toit called me on the 11th August 2026, the statement changed from - " Patient is alert and shows signs of intoxication"... to smelling like alcohol! A smell only indicates that alcohol was present.... Was it in my mouth? Or on my clothes? Smelling does not state I drank or if I was impaired. And why was it changed from showing signs of intoxication to smelling?.... I then went on asking Gerhard Du Toit what proof do they have, that I was intoxicated? Gerhard Du Toit responded by " The Dr. is a medical professional"..... True it is his profession but based on WHAT!!!!!!! Many Dr. has failed patients regardless of it being their medical profession. MIWAY DID YOU KNOW? Head trauma mimics drunkenness! No blood test was done. MIWAY please tell me was the Dr. guessing based on physical signs? Or his profession? And why was it changed from showing signs of intoxication to smelling? .... I require evidence and a report stating that I was intoxicated and that tests were done! I was treated on-site by emergency medical services (EMS) and subsequently transferred to Tembisa Hospital by ambulance. Due to the fact that Tembisa hospital was too slow in attending to me on the same date of the accident on the 5th August 2026, I then decided to leave Tembisa hospital in order to receive further medical treatment at Arwyp Private hospital and I was quoted a high amount, which I was not prepared to pay as i did not have medical AID. I acted as a financial prudent consumer! On the 6th July 2026, I then went to seek medical attention, which I did mention Waitse Setlhare who then advised me that it was not valid! And needed! My subsequent visit to a doctor the next day provides a valid, legal medical record which shows I had a concussion. Miway cannot simply choose to ignore a qualified medical professional report because it contradicts their preferred narrative. MiWay's rejection letter vaguely cites a failure to provide 'true and complete information' but fails to provide any specific details or proof. Because MiWay has not identified what information is missing or incorrect, this claim rejection is completely without merit. Please understand that I am not leaving this matter here. If this decision is not overturned, I will take the following steps: I will lodge a formal dispute with the NFO I will share my detailed experience, including the timelines and lack of communication, across all major social media platforms to warn other consumers. I will post reviews detailing this treatment on public consumer review boards. I expect a response acknowledging this complaint within 48 hours and a formal resolution within 7 business days.
