MiWay Insurance – Anti-Competitive Practices and ************** Against Small Black-Owned Businesses

We at Sublime Tracking (Pty) Ltd, a proudly black-owned South African vehicle tracking company, are deeply disturbed by MiWay Insurance’s conduct towards us and our clients.

Despite being a qualified and accredited tracking provider, two of our clients were recently told by MiWay that they only “work with three tracking companies” in South Africa – as if the other 50+ registered and qualified providers don’t exist. MiWay even went as far as offering to pay cancellation fees to lure our clients away from us.

This practice is:

Anti-competitive – it unfairly locks out smaller businesses and creates a closed market. ********* – MiWay is interfering with contracts that clients freely entered into. Discriminatory – black-owned small companies like ours are denied fair access to the industry.

We reached out in July 2025 requesting to be added to MiWay’s approved panel, but received no response. Instead, our clients are now being undermined and misled.

We must remind MiWay and the public that:

The Competition Act of South Africa prohibits exclusionary practices by dominant players. The Consumer Protection Act gives clients the right to choose their own service providers. The FSCA’s Treating Customers Fairly (TCF) principles require insurers to act transparently and fairly.

If this conduct continues, Sublime Tracking will have no choice but to escalate this matter to the Competition Commission, FSCA, and Ombud for Short-Term Insurance.

We are not asking MiWay to send us clients. We work hard to win our own clients. What we demand is simple: stop blocking and disrespecting our clients, stop undermining our contracts, and stop discriminating against small black businesses trying to grow in this country.

South Africa deserves fair, open markets where innovation and competition are encouraged – not shut out by a few players protecting their own kickbacks.
