additional excess dispute.

The end of Jan 2016 my Son had an accident with his bike, a bird flew into my son's path of travel and this was unavoidable, there was no way he could have avoided the incident due to traffic. The claim was authorized but now MIWAY advises of an additional R2000.00 excess due to \In the event of a public road accident where no third party is involved or traceable \" no ware on my policy schedule do MIWAY defined what the third party is, now we have to pay an additional amount because the Manager Dudu Maluleke said the bird is not a third party. Should my Son have caused an intentional accident and stood a chance to lose a limb or his life in the process would MIWAY have covered the incident? MIWAY refuse to pay out the amount due until I accept and signed the documents stating the amount of R4500.00 as my excess. My son was an innocent party to event that occurred as the damage to his motorcycle was not done intentionally. At the moment the bike is a health risk, headlights is not working, if my Son is in another accident due to the headlights not working I keep MIWAY responsible."
