Accident Claim

I was in an accident on 12 December 2016 and phoned Miway to report the accident and request a tow in service to be dispatched. I was advised by the operator that they would not be able to assist me due to the fact that I was in arrears with my insurance instalments. This was the first time that I heard about this. I had changed my banking details in November and had received a notification from the bank on 7 November 2016 advising that they did notify Miway of the change of banking particulars, which a service that capitec provides for client's who join their bank. When I phoned Miway at the scene of the accident they advised that they could not assist me and did not even register the accident on their records. The following day I contacted Miway again to confirm the banking details that they have on record, they advised that the banking details were still reflected as Nedbank, which was my old bank account, which was no longer in use. I then advised the consultant that I have proof that they had been advised of the change in bank particulars by Capitec. The consultant then transferred me to the accounts department and advised me that they should be able to investigate the matter to see whether the notification was received from the bank. The consultant also advised me to register the accident claim. I phoned again at a later stage in December and was advised that the claim had been closed due to non payment of the instalment (I had still not received feedback regarding the notification that was sent to them by Capitec regarding the banking details). They then advised me to lodge a dispute via email which was done. They have now eventually changed the banking details and deducted a prorate and normal instalment for December and January month. However I have still not received feedback regarding the investigation that was supposed to be done in respect of the bank details notification that they should have received from Nedbank and I have still not received feedback from the dispute department regarding the claim. I have now been sitting without a car for more than a month, but still they are deducting the insurance for a vehicle that is at this stage immobile.
