I rented a studio apartment through Millenial Realty from April 2025 to March 2026 and paid a R5,200 deposit in good faith. After moving out, I was only refunded R1,989.13. They kept R3,484.60 for "repairs" but have failed to provide any proper legal or financial proof. 1. No bank-generated proof of interest on my deposit My lease commenced on 1 April 2025. I paid my deposit prior to taking occupation in April 2025. Under clause 10.6 of the lease, they must provide proper proof of interest earned. Instead, they provided an internal screenshot showing: · Opening balance: R225.44 on 1 March 2026 · Interest: R19.75 (11 March 2026) and R20.95 (13 April 2026) They have not explained: · Where my R5,200 deposit was held from April 2025 to February 2026 · Why their record shows an opening balance of only R225.44 in March 2026 · Why no interest is shown for the first 11 months of my lease An internal system screenshot is not bank-generated proof and does not satisfy their own clause 10.6 – this was drafted by them by the way. 2. They used an invalid, anonymous invoice to justify deductions The Tax Invoice they provided has: · No supplier physical address · No supplier phone number · No VAT registration number · No signature · No company letterhead This document is essentially blank and anonymous. It does not prove that any work was actually done, that any amount was charged, or that they are entitled to deduct anything from my deposit. 3. Overinflated charges with no proof of payment They charged, for example, R700 to clean cupboards and a glass shower. They have provided no original dated slips, no bank-generated proof of payment, no name of who performed the services, and no signatures. 4. Missing legal documents Under clauses 20.10–20.17 of the lease, before any deduction they must provide: · A written quotation before the work was done · Original signed tax invoices from legitimate companies with valid contact details and VAT numbers · Proof of actual payment for each service They have provided none of these. 5. Neglected maintenance for 12 months I moved in with cracked tiles that make noise when you step on them. I reported them immediately. They came once to fix loose ones only. The gas meter system broke and we couldn't buy gas. This happened shortly after the new month started. I had already bought 8 cubes of gas for around R340 and lost that money. When I asked about a refund, I was dismissed and given no solution. Instead of addressing my loss, they made agreements with the body corporate to start charging gas costs directly with the rent. They told us how it was going to work going forward – but never once considered my interests or the money I had already lost. It was them and the body corporate, working together, while I was left out. The property was neglected for 12 months, which is why I left. All they did was collect rent – and then they kept 67% of my deposit. 6. Deposit deductions with no prior upkeep How do you claim R3,484.60 for repairs when basic issues were never fixed while I was a paying tenant? I even ended up paying for an oven light for an oven I never used – because the place came with no oven tray for the entire 12 months. The property was handed back in the same condition it was given to me, minus normal wear and tear. 7. They refuse to provide my move-in photos I requested my move-in inspection photos to prove the property's pre-existing condition (cracked tiles, etc.).They refused to provide them. If those photos would help their case, why refuse to provide them?. They deducted money from my deposit using an anonymous invoice and without providing bank-generated proof of interest as required by law and the lease agreement. They also neglected maintenance for 12 months, refused to provide my move-in photos, and then kept 67% of my deposit.
