CAR AUCTION

on the 28 July 2020 i registered for car auction with MFC NEDBANK AUCTION, and i was advised that upon registration i would be able to bid online. However i asked if i could bid at the auction house and was told is not possible.

On the 29 July i entered the online bidding for the first time and while i was on the online bidding i mistakenly click the bidding button which immediately within a second sold the wrong car to me without any confirmation nor any opportunity to rectify the error.

I immediately call them and advised them about the error but was told that because i accepted terms and conditions, despite the error occurred i was going to loose my R5000 deposit and will be suspended for 1 year without bidding.

i checked their terms and conditions and through my legal background they are silents about my situation and even if they are not, they are not consistent with consumer protection act.

Their system is exploiting us because if you do a mistake you are penalised for that mistake and even worse is when you have no clue how their online bidding works. their system is made in such a way that you are forced to either buy the car you did not intend to buy or loose your deposit.

I called other auctioners and their online systems are designed in such a way that after clicking bidding button or placing your bidding it allows you to confirm your sale and others even run for two days to allow you opportunity to make up your mind, but MFC run their bidding within 2/3hours and with this type of system whereby once you click a bidding button by mistake you stand to loose your 5000 deposit or buy a car you dont want.

that is not what the consumer protection act stand for.

i want my deposit back and i am willing to exercise my rights to expose this type of service that exploit consumers and abusing of powers
