DELAYED INCOMPETENCE

My Mom had 2 pension funds policies and during the 2nd week of September 2020 I submitted a claim as I am the only beneficiary on the policies. Metropolitan said that I need a letter from the GEPF showing the I am the beneficiary in order for funds to be released. What I dont understand is why that is a requirement because on the 2 Metropolitan policies it clearly states that I am the only beneficiary. I was able to get a letter from the GEPF showing that I am a beneficiary for the Government pension funds. I sent this letter to client service but no feedback as yet. Please respond asap with regards to the payment of the funds.

We are sorry to learn of your mother's passing.  Please accept our sincere condolences at this time of bereavement.

Please be advised that Retirement Annuities fall under the provisions of two pieces of legislation:
  1. The Income Tax Act
  2. The Pension Funds Act

In terms of section 37 C of the Pension Funds Act we are duty bound to pay to the insured's legal and financial dependent/s. 

Where a policyholder has nominated a 'beneficiary', it is not as simple as on a Life cover policy that is governed by the Long Term Insurance Act, i.e. we cannot simply pay out to the nominated beneficiary. 

We can use the nomination,  together with other information as an indication of the client's wishes, but we still have to assess if there are any other legal and/or financial dependent/s that may be entitled to a portion of the proceeds.

We will arrange that our Claims Assessor makes contact with you again regarding the outstanding claim requirements and clarify any further misunderstanding there may be in this regard.
