8 months still no pay

<p><br /> metropolitan refusing to payout. policy ********** 026<br /> <br /> <br /> Hi there<br /> <br /> My name is Pumezo Mafongosi <br /> <br /> My mother Mvf Mafongosi passed away last year june 2016 and she had a metropolitan cover which she was paying 1000 plus on it every month.My mother was employed by public works for 16 years and in service for 40 years.<br /> <br /> <br /> After her passing we concluded all documents to metroploitan for a payout and when we there we were told that her 3 children i my late brother and sister where the beneficisaries of that particular payout as the deceased had written our names. We took all neccesay documents for the claim .<br /> <br /> <br /> 5 months later in November we were told that there are kids involved which of my late brother and that we could no longer get any payment as they had my brothers kids best interests. From their trustees meetings we were singled out of somthing that was supposes to be ours.They said thier decision is based on age and so forth not considering that fact we were supported by my mother as we are jobless till this day.<br /> <br /> <br /> Its March now..we were in contact with them ....they informed us that they need the childrens documentaion. We sent that through and after we asked where the process was they said the still need to consult management on the payout as one of the children is under my supervision regardless of all documentation sent to them.<br /> <br /> <br /> We still waiting for them to make this payout and the sad part the child has no school fees money .We can nolonger carry the expenses and they has gone past the date we had planned.<br /> <br /> <br /> We need your help in this regard as we are not getting any answers especially for somthing that was due to us ..<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> </p>

Please be informed that the policy in question is a Retirement Annuity. Payments of benefits is governed by the Income Tax Pension Fund Act. The Act allows an administrator 12 months to conclude payment. Thank you for your patience in this regard.

Another excuse. ....lets start of by stating that funeral death benefit is still outstand from the time of death.Meaning metropolitan still needs to pay this yet this benefitbis emediate after informing or listing the claim.

Regarding our claim this is another excuse because liberty life payed out Sanlam payed out but it is metropolitan thats telling us stories.

In a inhouse communucation email to another employer you mentioned that the children where paid which is a false statement as till this date we are waiting.

Metropolitan has turned from a life insurance company to a trust holding company.After much consultation you decided to pay the childs school fees leaving all other costs to bare. This entire payout is delayed due to a feeling that the board of trustees is not comfortable with. ...a feeling not what the deceased has written. Whats even worse the deaseased has a will which clearly states all assets are to be distributed amoung her children and in the absence of the biological children not being present the children of the deseased are to claim for thier parents portion. Non of my mothers wishes were followed instead you have taken this entire claim apon yourselves and made all decisions based on your feelings as you have written.

Whats even more confusing is that if you paid the school fees ...what about the transport fees. The aftercare fees the food fees and general upkeep of the children. THUS concluding refunds must be made by Metropolitan to those who took this responsibility from the time my mother passed away in June last year till present.

The whole presentation by Metropolitan is vague

Dear Client

Section 37C of the Pension Funds Act of 1956 ("the Act") governs the distribution and payment of lump sum benefits payable on the death of the member of a retirement annuity fund. These benefits are colloquially known as "death benefits". They do not form part of the assets in a deceased member's estate. Instead, section37C, places a duty on the Trustees of the Fund to allocate and pay the benefit in a manner that it deems fair and equitable. Even though the member usually completes a nomination form, such nomination is not binding on the Trustees, as the benefit must be distributed strictly in accordance with Section 37C.
