Merchant Hunter refusing to give a refund
I placed and paid for my order in full (order 3141) on the 21st of September 2019. I read the terms and conditions and at the time the terms and conditions specified that the order could take between 22 and 30 days but that the dates were just guidelines. It could take up to as much as 90 days.
I followed up with them a couple of times to which they responded with their standard delivery times and that my order was still on route. One of the responses was "Please note, NO refunds will be processed for deliveries until it reaches 90 working days if it is due to a delivery time frame".
On 20 November I did my 3rd follow up. I asked if I was due for a refund as yet and they said that it is 90 working days and that the refund would fall in January 2020.
On the 28th of January I sent them an email + a facebook message explaining to them that my order was placed in September and that the 90 working days would expire on 30 January 2020 and that I would like a refund because I have not received my order as yet. The communication between us and the information read on their Refund policy was that I am entitled to a refund after 90 working days, hence my email to them requesting for a refund.
They responded on the 29th of January 2020 saying that the order is still on route and that there were further delays. And then I received the link again on their refund policies, which reads as follows:
"NO REFUNDS offered unless for an extraordinary reason that has been determined and agreed by us (such cases may be items no longer available or will take longer than 90 working days to deliver, however this does not include buyers remorse or damaged items. Buyers remorse we do not refund or exchange. Factory items will be replaced as per below). This is up to our discretion (i.e we can request a refund but it may or may not be approved irrespective of time frames).
Please note, no refunds will be processed for deliveries until it reaches 90 working days if it is due to a delivery time frame (all cost are taken into account and factored into process from date of purchase, therefore with challenges mentioned above it is not feasible to process any refund prior to this date). No refunds on Specials, Clearance items. Only fully priced items will be looked at after 90 working days subject to our refund policy"
I responded saying that I do not have buyers remorse and that I have not received the items that I ordered and that I want my refund and that if I do not get my refund that I will go to Hellopeter.
Their response to this was that I will delay not only my order but other people's orders by going to Hellopeter and social media. They apparently do not hold onto the money and cannot process the refund and that I have to wait until my order arrives.
I am also apparently not allowed to harm their brand by posting anything on Hellopeter or Social media.
So my question is now, what rights do I have as a consumer if something that I ordered keeps on being delayed (so they say) and that I am not entitled to a refund? Do I just have to keep waiting for months to come and hope that one day I will get my parcel?
I purchased goods, which I have not received. On the 30th of January it will be the 90 working days but I am not entitled to the refund even though they specify this on their website and this was the communication between us.
I am disgusted in the way that they deceive their customers and they are actually still in business. I cannot comprehend how a company can sell goods to customers but when it comes to them not delivering that they say they cannot refund you.
I've purchased a lot of goods from China directly and after the delivery timeframe expires, they give you your money back if you have not received the order. Not with this company and they are a South African company.
I want my money back. I am not going to wait for another 6 months to a year for you to deliver the goods that I ordered. I have a right to get my money back and I will take this further, I am not leaving this here.
1. Raising a Hellopeter complaint and having to prove to Hellopeter that my complaint is legit because Merchant Hunter reported my complaint as false. Nice try Merchant Hunter.
2. Having to raise a complaint at the Consumer Goods and Services Ombudsman where they gave Merchant Hunter two weeks to respond. And bam, my order miraculously was delivered today after the 2 weeks.
