Appalling service from MBSA and SANDOWN MOTORS

On Wednesday, 23 November 2016, I had the misfortune of taking delivery of a 2016 C63 S, from Constantia Kloof Mercedes Benz. Whilst still at the dealership, checking the car before taking delivery,I saw a "SERVICE OVERDUE BY 14 DAYS" alert on the cluster. The sales rep`,Khoketso, whom readied the car for pick-up was questioned about this. He informed me that it was an error on the computer box which the service department needed to clear. It would take 1 hour to sort out. Khoketso also informed me that it was nothing major and I could drive the car down to Durban error onboard and have it sorted out when I am back home. He made arrangements for me to take the car through to NMI - Durban the next Tuesday, 29 November 2016, to have this error cleared. I was still under the impression that it would take just 1 hour to get my new car sorted out. On my arrival at NMI on that Tuesday, I was asked to leave the car behind as it was going to take a few hours. I comp**** and was merrily on my way without my R1,5 million rand car.
10 days later, the fault is still not sorted out. My R1.5 million car still sits at NMI-Durban in exactly the same manner as I left it more than a week ago. I have made, with no exaggeration, over 100 calls to Khoketso(sales rep), Alda Waddel(DP @ Constantia Kloof), Lance Mooney(MBSA) regarding this car and everyone keeps giving me the run around. My calls are either not taken, not returned or met with the meaningless words "It's nothing major. They are working on it"
The gravity of this matter is not being taking seriously by any of the parties.
Through no fault of my own, I have paid the 1st instalment on my new vehicle which I have literally only had in my possession for 4 days. It is now parked off at Mercedes with a problem that can not be sorted out.
Firstly, a car with a fault on it should never have been supp**** to me from the outset. In good faith, I took the word of the sales person that the issue was extremely trivial and took delivery of the car. It is definitely not minor considering that after 10days of working on the car the fault still persists and nobody seems to know how to remedy it.
Secondly, within 7 days of signing the contract, I informed Constantia Kloof Mercedes that I wished to cancel the deal. I was told that this was not possible as I had signed a waiver at the dealership. This waiver was not brought to my attention. I have still not received the signed contract with this waiver which was supposed to be emailed to me by the financial officer. Had I been made aware of this waiver I would not have taken delivery of a vehicle with a fault on it.
I was also informed that I should give Mercedes Benz South Africa the opportunity to sort out the problem. I have given Mercdes-Benz South Africa 10 days to sort out the problem. Not only has MBSA not sorted out the problem, I have received 0 communication from MBSA regarding this matter and the steps taken to sort it out. I paid for a C63 S that is in perfect working order. I want a C63 S that is in such condition. I refuse to grant any entity more time to sort the situation out. It is simple. I want a C63 S with no faults given back to me immediately.
What is most upsetting is the complete lack of interest, communication and concern form MBSA. Being a business owner myself, I know how negative publicity on public platforms affect a brand, I gave MBSA the opportunity to deal with this matter in-house, before taking it to public platforms. My numerous emails and calls have received no response. The only helpful person in this entire sad situation has been Ibrahim the service manager at NMI Durban. He has tried his best to get the car sorted out but through no fault of his the problem can not be diagnosed. The injustice here is that this car was sold to me by Constanta Kloof and not NMI but it is now NMI's issue. Constantine Kloof - Mercedes is completely dis-interested. The sales rep and the DP at Constantia are ***********. Lance Mooney from MBSA is avoiding my calls and Ibrahim calls. So I am left paying for a R1.5 million car which I can not use. The point to remember is, this car had a fault before I took delivery of it. This fault did not occur whilst I was driving or whilst the car was in my possession. This fault was prevalent whilst this car was still on the showroom floor at Constantia Kloof Mercedes.

Anybody thinking of buying a Mercedes, think again! The luxury the car provides does not warrant the pathetic after-sales service. If it can be called a sale at all considering I drove my new car for literally 4 days
