Our company lost contracts, I fell in arrears with my WW personal loan payment.
I explained that I will pay as I get payment from our suppliers: We now invoice weekly but the agents insist that I must commit to a date.
I paid R1100 on 23/02/2016 and another R1000 on 28/02/2016.
Received a call yesterday advising I need to pay a further R800 before 09/03/2016 or will be served a summons. I explained I can only pay R400 on this date. This is apparently not acceptable.
So I paid R2100 and will pay another R400, thus R2500. Because I cannot pay an extra R400 you will issue summons? Worst is that I will be able to pay the R400 by next week.
I have made bona fide payments: I am not trying to dodge responsibility.
Do you get extra money if you take the matter to court? Is this reasonable/ logical?
The irony: I do not have assets left. You can get R10 000 if you are lucky if I am sequestrated and due to my cut in salary a garnishee will not be in your best interest.
Should you take the matter further I have no reason to pay at this stage. I know that there are reasons and a system but implore you to use common sense. The arrears will be paid. Summons will be detrimental to you and me.
