In 2013 I joined the local Virgin active gym in Welkom. In about 4 months after joining was assaulted at the gym by a **** that was encouraged by the Virgin active manager at the time. On the Monday night I had moved a tog bag from a machine as I needed to continue my routine after waiting 15 minutes with the owner not showing up. The owner then showed up while I was busy on the machine and shouted that he was going to moer me. I apologised and continued with the rest of my routine as I thought the incident was resolved. That Wednesday, as normal waited for my gym partner outside. I messaged him to find out where he was and he rep**** that he was already inside. I made my way through the entrance of the gym and was confronted by Jan, the **** from the Monday event. He was shouting and swearing at me. The manager of Welkom Virgin active was shouting ruk sy kop af encouraging Jan to beat me up. Jan pushed me outside where he punched me to the ground and kicked me. Jan was double my size and I had no intention to even try defending myself. I got up and immediately went to the police station and opened an assault case. The next day Jan phoned me and apologised. He claimed that he had children and cant go to jail. This was obviously not his first offence, but he sounded sincere so I dropped the charges, though was upset about the fact that the manager had a part in my assault on the Virgin active premises. I tried phoning in to Virgin active to speak to a superior with no avail. The consultants refused to put me through to a person of authority. I then went to the Virgin active website and lodged a complaint. A while later a lady phoned me from Virgin active and apologised. She claimed that action would be taken against this individual, but reminded me that even though I do not want to return to the gym that I still had to pay the fees for the two years as per the contract. I was not happy with the situation, because accoding to my layer they were in breach of contract. They were supposed to provide a safe environment for patrons which they did not. I though continued with payments to avoid problems. In December the following year I was contacted by the new manager of the Welkom Virgin active enticing me to return to the gym. I told him that I was not interested and asked him to stop the contract after the 2 years with was the February that following year. I fully paid the two year contract even though I had only used their facility for 4 months. A few years later I was contacted by MBD. I explained the events, but the constant threatening sms messages and calls have continued for 2 years now. Even calling Virgin active did not resolve the matter as their legal department claims they know nothing of the matter. I have consulted with my layer on many occasions with regards to this matter and was told by her that if I sued Virgin active and MBD they would throw money into their defence to save face and would cost me lots of money. I have challenged MBD to court on numerous occasions on instruction of my lawyer, but they have not stopped harassing me. Virgin active and MBD owe an explanation for their actions. I have been advised to try Hello Peter, but have also been advised that there are various cases that can be made against them. I am now going to fully pursue this matter leaving no stone unturned if the is no resolve.
