Transfer re Title Deed

I (Edwin Mathibela Moeketsi) an irate Purchaser, purchased Erf 1564 Geluksdal, Extension 1, from estate late F.S. Nhlapo and N.E. Nhlapo. My understanding and my broader consultation, when one purchases a property, he/she will need to have the property's Title Deed transferred into his/her name. The Title Deed of a property serves as proof that you are the rightful owner of the property. A Title Deed does not only define proof of ownership, but also states the details of a property, conditions and purchase price). Pursuant to the above, the process of having a property’s Title Deed transferred to my name happens, amongst others in the following way: - The transfer Attorney (appointed by the seller) prepares all the documents needed for registering the property transfer.

In terms of the Agreement, (attached for ease of reference) Masango Attorneys were appointed as the conveyancing attorneys. It has transpired from a deeds search, done, that the property is still registered in the name of the seller. I’m now fed up with the process after battling for 5 years to secure the Title Deed to the property I purchase, I now want to exhaust other channels for example (Law Society, Courts including the Media etc, in trying to resolve the matter.

Five years later, I am still without a Title Deed. Currently am living at my deceased parent’s house which I share with my siblings in Tsakane. Upon purchase of the property I wanted to get my Title Deed so that I could start building a home for my children who are now deceased. (Sad that the dream I had with them do date not realised due to the dishonesty from the seller and attorneys duly appointed)

My parent’s house is no longer the place for me, for my situation I need to be relaxed. Even after approaching lawyers, I did not receive a Title Deed. I am tired of waiting, if the seller don’t want to give me the Title Deed I suggest that the matter be resolved through a legitimate relevant court of law, the seller must just give me my Title Deed for the property and I will let the matter go. This is making me sick. I get nervous breakdowns because I eat, sleep and think about this property.
