MAKRO DOES NOT ACT WITH CUSTOMER INTEREST IN MIND OR ACCORDING TO CONSUMER PROTECTION ACT/TREATING CUSTOMERS FAIRLY
I had purchased the TV with the organisation on the 20th of August 2022. I had received confirmation of my goods on the 21st of August 2022. Following this I received a mail from Makro on the 27th of August stating that Makro had incorrectly priced the TV and an alternative was offered which I have declined as it was not as per the CPA "the same or of better quality". As described in my original response to Makro, this was a violation of the CPA specifically section 30 and it was Makro's responsibility, and the onus is on Makro to deliver the goods I have purchased.
After no feedback was received, they have cancelled my order as of today(7 September 2022) and have not refunded me the money paid (With interest). The organisation has broken several rules which include:
A) Right to fair and responsible marketing - Bait marketing, B) Failed to deliver on the right to disclosure and information: More specifically - Disclosure of price of goods or services, C) Right to fair and responsible marketing - General standards for marketing of goods or services, and lastly D) Per section 47 part 3 "If a supplier makes a commitment or accepts a reservation to supply goods or services on a specified date or at a specified time and, on the date and at the time contemplated in the commitment or reservation, fails because of insufficient stock or capacity to supply those goods or services, or similar or comparable goods or services of the same or better quality, class or nature, the supplier must— (a) refund to the consumer the amount, if any, paid in respect of that commitment or reservation, together with interest at the prescribed rate from the date on which the amount was paid until the date of reimbur*****t; and (b) in addition, compensate the consumer for costs directly incidental to the supplier’s breach of the contract, except to the extent that subsection (5) provides otherwise."
This type of misconduct is unacceptable for a large corporate
It is actually comforting to see that at least a response is provided when grievances are taken public. When feedback was requested on several occasion through your help desk email it would of been nice to have received a response. It would of also have been nice to receive feedback when email communication was escalated to the CEO of Massmart.
I would like to understand how my product was canceled (Against CPA)? How a products of lower quality were attempted to be provided as compensentation(Against CPA)? And why no feedback was provided which is a post barrier of sale (Against TCF)?
How does the organization deemed this acceptable? Will i receive the goods i have purchased, yes or no?
