Refuse to cover what's in their policy

I took someone to court over the money he owes me via Lipco, I got a warrant of execution and the sheriff has found that the person does not have valuable property to attach. Now I want the attorney to garnish him but LIPCO says they will not cover for the attorneys fees while in my Platinum Policy document they say : 1.1.1. Civil actions: a. Where you want to sue another person for money, goods or services based on a written agreement. Remember that we cannot cover you if you don’t have a written agreement with the other party.
