Legal Cover Rejected Because I Intend to Rent Out a Privately Purchased Property

I am extremely frustrated and disappointed with the way my request for legal assistance has been handled.

I approached LAW FOR ALL for legal advice regarding a property transaction between myself, in my personal capacity, and a private individual selling her residential property. I am not purchasing a registered business, shares in a business, a commercial enterprise or anything of that nature. I am simply purchasing immovable property in my own name.

Yet my request for assistance has been classified as a “business-related matter” and declined under the business exclusion in the policy. The rejection letter specifically relies on Clause 2.1.3.2 relating to business-related matters.

What makes this particularly frustrating is that the apparent basis for treating the transaction as a business matter is that I have indicated that I intend to rent the property out after purchasing it.

That reasoning makes absolutely no sense to me.

What I choose to do with my property after I own it should not automatically change the legal nature of the transaction through which I am acquiring it. I could purchase the same house today and live in it, let a family member live in it, leave it vacant or rent it out. The legal assistance I am requesting relates to the sale agreement between a private purchaser and a private seller, not the operation of a business.

I specifically need a lawyer to advise me on my contractual rights and obligations arising from the agreements I signed, particularly because there is now a dispute regarding a separate R200,000 agreement connected to the transaction. Instead of receiving the legal assistance that I believed I was paying for, I have effectively been told that I can be referred to one of their panel attorneys at my own cost. Their own letter confirms this.

That defeats the purpose of paying for legal cover.

What concerns me even more is that this is not the first time I have experienced an extremely broad interpretation of the “business” exclusion when requesting assistance. It leaves me seriously questioning what meaningful legal protection I am actually receiving for my premiums.

I am not asking LAW FOR ALL to manage a rental business for me. I am not asking for advice relating to tenants, rental income, a company or commercial operations. I am asking for legal advice regarding my personal contractual exposure in the purchase of residential property in my own name.

If LAW FOR ALL maintains that this falls within the business exclusion, then I would like them to explain clearly and specifically which aspect of the legal dispute itself is business-related, rather than relying on what I may intend to do with the property after the transaction.

Their letter does at least state that I may have the matter formally assessed by the Claims Department and use the complaints and appeals process if I disagree with the exclusion, and I intend to pursue that process.

At this stage, however, I am deeply dissatisfied. I paid for legal cover specifically so that when I am exposed to a serious contractual dispute, I can obtain professional legal advice. Being told that a private property purchase becomes a “business matter” merely because the property may later generate rental income is, in my view, an unreasonable application of the exclusion.

I would like this matter reviewed by someone senior who is prepared to look at the actual legal assistance being requested, rather than simply applying a broad label to the property because of its intended future use.

One thing I would not put in the review is that their interpretation is definitely “*******” or that they are “breaching the policy” unless your attorney has confirmed that. You don't need that accusation. The facts themselves make the complaint strong: private person + residential property + contractual dispute + future rental intention = they classified it as business-related. Make them publicly explain that logic.
