<p>My name is Stephen Bennett and ran a company called API Solutions SA (Pty) Ltd that had a provident fund with Liberty Life.</p> <p> </p> <p>As with many companies today. Things are not easy. The company fell behind on its payments to liberty Life. Within an extremely short period of time liberty Life was demanding its money. The people at Liberty Life, namely Shaina Singh and Johan Riekert through the awful representitive for Liberty Life named Nivern Maharaj - harrassed me daily with veiled legal threats of every proportion to force us into making sure Liberty Life got paid up to date. It was terrible. So much so that I started a retrenchment process of all the staff. This was a major factor in making that retrenchment decision.</p> <p> </p> <p>After requesting that the fund be paid up to date. With numerous provable emails send to and rep**** by Liberty Life. I made sure that this Provident fund was paid up to date according to confirmation by their representitive Nivern Maharaj and the people at Liberty Life. I wanted to insure that this was in place because I knew that the people about to be retrenched would need this Provident Fund by making a withdrawal so they could survive.</p> <p> </p> <p>Not the case. I have an email to prove that Nivern Maharaj send to me to not contact Liberty Life because that he could not and I quote "get favours" completed at Liberty Life if I did. Its disgusting. Liberty Life are nothing but legal ********* *****ing from the public.</p> <p> </p> <p>The one person contacted Nivern Maharaj (Liberty Life's representitive) in 2015. I have an email from him to say he would help this man to have the funds released. Its now 2017 and this poor man is still waiting.</p> <p> </p> <p>I have since discovered that the only person who has been able to get a release is one former employee who laid a complaint with the PFA. Liberty Life knows that most of the public are not s****ed enough to do this. His funds were released. Liberty Life uses the system to withhold the funds from the public. They use the system to ***** from the public because they know that most people do not have the s****s to lodge complaints against them through the PFA.</p> <p> </p> <p>I have taken this matter further. I have been dealing with Primmy Naidoo, Lesley Chetty and Janet Opperman all working at Liberty Life. They use lies to purposely DELAY you in the hope that you will go away, to KEEP or in my OPINION ***** your money.</p> <p> </p> <p>FIRST LIE TOLD TO ME BY THESE PEOPLE WORKING AT LIBERTY LIFE - The fund was not fully paid up. I have documented prove that this is NOT the case.<br />SECOND LIE - The fund went into liquidation (Liquidation allows them to legally keep your money indefinately or "its a very long process" so that they can ***** from you even more - while they earn interest on your money - *****ing in other words) before you made your claim to withdraw. Its a complete LIE and I have documented proof to prove this.</p> <p> </p> <p>Liberty Life should not be allowed to operate in this country. They are nothing but *********.</p> <p> </p> <p>I have laid complaints against them through the FSA and the PFA.</p> <p> </p> <p>Please whoever reads this stay well away from this company that is nothing but ********. Tell as many people as possible not to ever use Liberty Life. They are totally DISHONEST.</p>

Liberty Corporate has responded to you on this matter. Making withdrawals from a fund where a member has resigned is completely different to that of making withdrawal from a fund that has gone into liquidation.
When a Fund is terminated, the employer no longer pays the contributions to the fund. The liquidation procedure must then be followed in terms of the Pension Funds Act.
This an extremely complex process and is likely to take several months to complete. While the aim of the legislation is to safeguard the interest of members, it does delay the eventual payment of benefits to members.
The main points of the liquidation is as follows:
- The Board appoints a liquidator to the Fund and applies to the Financial Services Board( FSB) for approval-(60 days)
- The assets are transferred to an interest bearing portfolio to eliminate exposure to market fluctuations-(10days)
- The liquidation accounts are drawn up and are then open for public inspection for a 40 day period. Total process takes 60days
- If any members have objections, then these must be lodged within 14 days after the advertising period.(14 days)
- The liquidator will then apply to the FSB to make payments to the members(30days)
If approval is granted, payments are processed - The liquidator then draws up final liquidation accounts and applies to have the Fund de registered.
Based on the information above it is clear that our intentions are at all time to ensure the members received their funds. We are however bound by legislation. Once the process has been completed and we have received the instruction from the FSB we can proceed.
