LexisNexis South Africa, an oprtunistic and unaacountable legal resource service provider

Take care to ensure that this company terminates access to their online services upon the expiry of any fixed term contracts you may have with the. We entered into a fixed term contract, which I elected not to renew due to my frustrations with their antiquated search engine. I assumed that my access was terminated and as such I was not perturbed about any of my staff, past or present, accessing the online services. When they sent statements reflecting a further full term contract amount being due I enquired into the situation. They purported that their agreement makes provision for automatic renewal, which I pointed out was not the case. They responded by sending me another document, which was not signed by me and which contained an automatic renewal provision. I pointed out that their contract had very specific alteration provisions which set the requirement for amendments thereto to be that it be in written form and undersigned. They responded by providing me usage logs showing access to the system, upon which I pointed out to them that we expected termination of our access and that the usage might have been by previous or uninformed staff or even an error on their side. Their only response was to involve a debt collection agency in demanding full payment. It is apparent that their company culture is opportunistic and dismissive and that they fall short of ethical business practices. The aforementioned is not even a full account of my interactions with this company pertaining to this issue and others. I have invited them to issue summons and I look forward to ventilating all y concerns at the hearing of this matter.

Dear Riaan O
Firstly our sincere apologies that we did not see your above complaint on Hello Peter until this week due to an issue with our admin access.
We apologise for the frustration you have experienced to date.
We are however in possession of a contract signed by you which clearly states that the product will be automatically renewed i.e.: "You are purchasing an annual subscription to the products you have chosen. The subscription is automatically renewed upon its anniversary date and upon all subsequent anniversary dates thereafter, until such time as you cancel it in writing at least thirty days before an anniversary date.”

This signed contract can be made available to you should you require it. LexisNexis has already in good faith credited you for year 2017 and your company subsequently continued accessing the product.

You are welcome to contact me directly on *** or Tel. *** to discuss this further.

Kind Regards
Neliswa Mncube

Dear Sir, Thank you for your comment to my complaint. You are however remiss in your assertion. The purported term you are quoting does not form part of the terms and conditions of the signed agreement. You will not find my initial nor my signature on any documentation containing such a term, I have verified this. I have also communicated this in the pas with other representatives of your company. I would thus suggest that you acquaint yourself with the full background to matters before you attempt to lay blame on your customers in the public domain.
