****** who won't pay back my money

<p>I was interested in renting a property listed with Letting People. Joyce Venter assisted me and was very nice...pratically begging me to quickly pay the R1000 holding deposit so she can secure the property for me so that one of the other agents don't lease it to someone else.</p> <p>She clearly explained to me it is refundable if Letting People declined my application and that it is only non refundable when I decide that I am no longer interested in leasing the property.</p> <p>Yesterday she came back to me to say another property I leased under my name is in arrears. The property in question was rented by me for my sister who did not qualify at the time.</p> <p>Then they declined me. So i had to send her my bank details to pay back my R1000 yesterday when her financial manager does the refund.</p> <p>Then suddenly she comes back to me telling me that i won't get my R1000 back because on my payslip she sees the address for the place. What does that have to do with anything? So what if the address is on my payslip? Besides I used that address for post for work, insurances and my medical aid. My name is on that lease so i am very much entitled to use that address.</p> <p>Then she comes back with another excuse about a no cooling off period. What cooling off period? A cooling off period does not apply anywhere if the coming rejected my lease application. It only applies when I decided to not go ahead with the application.</p> <p>Bottom line.........They rejected me said they cannot approve my lease application.....NOW I WANT MY MONEY BACK...simple>>>>>> What have they done for me to retain my R1000? and they will find someone who they will approve for leasing that property and then they will have all their required deposits as the should.....I want my money back............Joyce Venter must not come with her stories and every possible way to hold on to my money....what ******</p>

Still awaiting for a response. Carolynne the finance manager was so unprofessional, she decided to stop reading my emails and sent it staright to her deleted items.......SO DISGUSTED

  1. Ms Gates completed & signed an application form, said forms last paragraph is very clear in that by signing the form Ms Gates declared that all information provided on the application form was true, correct and agreed to pay the administration fees relating to the assessment of her application. Said paragraph last sentence, in bold & underlined is written ''we reserve the right to claim costs pertaining to the verification of the information provided on the application form from the holding fee paid''.
  2. Ms Gates has a letter of receipt for the holding fee, signed by herself, which clearly states ''is found that ********** documentation has been provided or we have been provided with misleading and or incorrect information, you will/may forfeit any or all monies paid to Letting''.
  3. On the application form Ms Gates stated she has resided in the same address since 2008.
    1. Ms Gates, in her complaint above, has admitted to this address and that it is/was rented in her name.
    2. 3 Credit Bureaus reports provided 2 other residential addresses listed for Ms Gates 2015 and 2016 which Ms Gates did not disclose on her application.
    3. The rental agency was contacted for the address in question for a report on the conduct of the rental account. We were advised in writing
      1. Ms Gates and her child resided in the property, were the occupants and her her sister as alleged above. If Ms Gates had indeed rented the property in her name for her sister, at law she is therefore laible for the unpaid rental;
      2. the lease is/was in Ms Gates name,
      3. that R21 000.00 was owed in arrears rental;
      4. that Ms Gates did not give notice and absconded from the property.
    4. The law states that the fee's for carrying out due diligence before approving an application may be recovered from the applicant.
    5. A considerable amount of time and expense was expended on this application in light of the information supp**** that was not accurate, conflicting addresses on the payslip and bank staement, no mention of the rental of this other address and denial of the amount in arrears when brought to her attention.
    6. It was our conclusion that the applicant did not disclose all the facts and did knowingly provide misleading/inaccurate information to with a view to enhancing the application.
    7. Ms Gates would have been hounded for the rental by the agency, would have received sms's, emails, letters of demand and rental invoices from the rental agency in question and therefore would have known the account was in arrears.
    8. In terms of the law - we MAY charge for administration fees and recover same from the applicant, we are exercising that right.
    9. The documentation in Ms Gates possession is clear - above where the applicants signs, as is the receipt letter.
    10. It would seem that Ms Gates was made aware of the matter of this arrears rental as Letting People is the 4th agency in this month Ms Gates has made application to for a rental property.
    11. It is regrettable that Ms Gates chose to use a public forum to address the matter at 08h30 on 28/11/16 BEFORE contacting the writer for a full explanation, we would not have been forced to publicly make these facts known to clear our name of being ****** who do not refund money.
    12. We are legally within our rights to recover our costs.

and the company clearly does not have their facts.

I stayed at the property with my child is being said...how is that possible? then where does my partner, my nanny and my other child stay? my household consists of 5 people

so it is clear that my sister and her child stayed at the place like i have said from the start

and i have been looking for my own place so of course i did not only apply to one agency. i would have been a fool to just apply to one having seen different places that i like. and i have since been approved for one of the places.

clearly Letting People- Carolynne is looking for a way to hold onto my money because she decides i stayed there when she doesn't have all the facts

i rented that place for my sister, she did not qulify because they needed x3 salary. my name is on the lease and i have used the address for post for medical, insurance and work because i do not get post.

Letting people must also get their fact straight. i was never contacted for outstanding rent

i have never provided any misleading info. i heard 1st of this when joyce told me and i called the agency myself and they confirmed outstanding balances

also i have tried to have the matter resolved before i went to this forum but Joyce stopped to reply. She only rep**** again after she saw i took it to a public form.

And i do understand it is out of her hands. she referred it to Carolynne- who just decided i did stay there...had no fact..and on top of that is most unprofessional as she started sending my emails straight to her deleted mail without reading it.

that makes it clear that she...and I would say letting people as she represents them does not want to pay my money back and is looking for an excuse to not pay it back and i stand by the fact that they are ****** WHO WANT TO KEEP MY MONEY WHEN THEY DID NOTHING FOR ME. it is your jobs obviously to work on applications you receive and you get salaries for that. So telling me about extensive work you put in and putting that also as another reason to not wanting to pay my money back tells me again they are looking for all sorts of excuses.

Like i said someone will rent the property and they will get all the deposits etc so why shouldn't they pay me back

where on your application does it state i must provide addresses for everywhere i stayed?

29 schreiner street and 698 schlapo street is the same house. the one is the plot number and the other is the street address where i have stayed since 16dec2008

Letting People are ******. They are the only agency by the way who charges a holding fee.

all other agency does exactly what they do but you only pay once you approved.

so again it tells that they may be rejecting a lot of people and look for all sorts of excuses to keep the money. Enriching themselves and hiding behind"right reserved"

And Carolynne could easily pay my money back- she is the financial manager and she has my bank details.

she probably gets a bonus from the extra money she brings in for the company by holding onto the R1000 paid by applicants

Contrary to popular belief, subscription fees 3 credit bureaus, phones, cost of multiple telephone calls, printing, drawing up of leases, the cost of staff, bank charges for verifying banking details, bank codes and bank reports.

We have to PAY for each and every phone call, every credit report we run, every bank report and so forth -none of these services are free to us.

We have an email from the rental agency to whom the R21 000 is owed stating the lease was in your name and that you resided there.

The agency would have had your email address,work phone number and cell phone numbers as you rented the property and all correspondence and rental invoices would have been sent to you as required by law.

The law is that if you signed the lease and the lease is in your name, you are responsible for the costs irrespective of who lived there.

Again- all agency do exactly what you do- and none of them asks a holding deposit...none

you clearly do that to keep people's money and answer them with clauses.

I have never said that i am not responsible- of course i am as i signed the lease

and my sister stayed there, what proof do they have that i stayed there. i signed the lease and obviously they were under the assumption i will be staying there

You have been and still are looking for every possible excuse to keep my money

The holding fee is, as you well know, a fee to secure the property from being rented by someone else and gives you 48 hours to get all the paperwork in for the application. i f your application is successful the holding fee is paid against your ENTIRE first rental invoice toward the rent and the deposit, it does not go in our back pocket.

If we were keeping back lots of peoples money this site would full of complaints about us - it isn't.

The remark about me personally receiving a bonus by not refunding applicants and now again will be referred to my attorney for defamation. We reserve the right to defend ourselves and myself should you continue to make slanderous and defamatory comments in ANY forum, all legal costs will be for your account.

This matter is now closed and no further comments will be rep**** to. The matter has been explained, resorting to personal attacks on me and levying insults is not going to change that we may legally claim our costs.

As you have stated the matter is now closed and that I am resorting to personally attacking you. I have also contacted your company and await feedback on how the Principal officer will resolve the matter.

You never acted in a professional way from the time you got my complaint you just decided because you were upset that i complained on this site since joyce 1st stopped responding.

about you getting a bonus for keeping the holding fees, read what i said.."probably"

and since the holding fee is to secure the property- which is what i was told and exactly what you said would have been deducted from the deposit- why still hold onto it when you DECLINED my application

You took the matter personal from the first time you responded to my email forwarded to you by joyce.

And you still act in an unprofessional matter by telling me the matter is now closed when according to me has not been resolved.

A decision was taken in light of the complainants insistence she was unaware of the unpaid rental account and arrears on the property rented in her name for her sister we instituted and investigation into the report from the rental agency who stated the complainant did reside in the property. Based on the information made available to us during December (whilst our offices were closed), we found the information supp**** to us to be inaccurate thereby compromising the complainants ability to rent a property. in light of the inaccurate information provided to this agency and in accordance with our refund policy for applications that we decline, we have today refunded the complainant the holding fee paid by her, in full.

Had the outcome of the investigation details reached us before we closed, the refund would have been actioned long ago. We regret the stress caused the complainant by the inaccurate information supp**** to us by the other agency.
