BEWARE OF LPA

We received a call to come and collect the voucher we apparently won for a weekend stay in Mount Amanzi. I was advised to bring my partner along. When we arrived a guy named Mlungisi started doing a presentation convincing us to buy timeshares. We asked if we can take the contract home with us and think about it then maybe we might decide to take the offer, he refused and said the offer is only for today. He continued to tell us that we will ONLY be paying R492 per month. We were told to do an EFT of R3800 without signing any contract and told to come back the following day as the admin who was supposed to prepare the paperwork and give us the voucher was not at work.

We came back the following day, and Mlungisi said he had a presentation in a few minutes and made us sign the contract without going through it. A month later we received a statement saying that the debit order will be R492+R710. We called Mlungisi to ask what the R710 was about as we only agreed on R492. Mlungisi blocked our calls and on Whatsapp. We checked our contract and indeed we agreed to pay that R710 and R492.

The voucher they gave us was useless because whenever we tried to book for a stay in resorts we were told about, there's always no space available. Even for next year.

My partner is under debt review and I am blacklisted. We tried to cancel the contract as were were under a lot of financial difficulties. We decided to cancel the contact before the first the first payment. We wrote them an email of cancelation giving them a 20 days notice in terms of the Consumer protection act 68 of 2008 sec 14.2.b.i (bb) as we both do not qualify to have more debts. We were told to pay R11000, which we do not have, to cancel the contract.

Is LPA allowed to get consumers who are under debt review and blacklisted into more debt? Isn't that reckless lending according to CPA? I feel that the LPA was not fair and honest with us from the moment we received a call that we've won a weekend away. We never even used their services as their resorts are apparently fully booked until next year when the voucher will expire. We were never given a chance to go through the contract before we signed.

We decided to rather take this matter to court to resolve this issue. We've already notified our lawyer and hopefully we'll be able to settle this in court. We are waiting for summons.

PEOPLE PLEASE DON'T EVEN GO TO THEIR OFFICES IF THEY INVITE YOU TO!!!

We have not yet received a call from you. Please provide us with a contact number as it is difficult for us to comment on why you signed a contract with financial commitments knowing that you are under debt review. We would like to find an amicable solution.

Isn't your responsibility too to conduct an affordability assessment before you finalise the Agreement? I called and you guys said I should make arrangements to make payments for that R11000. I was denied an opportunity to go through the contract as I wasn't allowed to leave with it before we signed it. I have reported this to CPA, and I'm still waiting for their response. I will no longer respond to any of your messages, phone calls or any form of communication. I will only respond to your summons.

Good day,
Affordability assessments are done on credit agreements, you must have signed a lease.  Onus cannot be on the business if you knew you cannot afford before signing the contract. We're sure they would not have allowed you to sign if you told them you are black listed?
