Deposit paid but still no pool

Gary Fourie committed to installing a fibreglass pool in my garden within a week of my payment of a 50% deposit. His crew came and dug a hole in my small garden on Friday 6th November and I have not seen him since then (today is 5th December 2015). In the interim Gary Fourie has made promises and told lies (which I verified with a third party) about how he's going to deliver the pool I've ordered. He is ********* and unprofessional and is in breach of contract. I've requested a refund of the R30k I paid to him and I am still waiting. My good faith was abused and this man should not be in business. (I did call references and later found that one of them was his friend and benefits from the business Gary Fourie gets).
