Please do the right thing and stop wasting people’s money and time .As per below emails from Kempton park branch they promised that the claim will be covered and it was guaranteed .First the claim was rejected because i did not provide with the permanent place of residence statement and when the statement was provided the claim was rejected for the following reasons 1.The address provided on the application for legal wise membership is not the same address involved in the dispute . Why clarifying this now with the claim? I was under the impression that the residential address is the address am staying at so the address completed at inception is not even my property is sister’s . legal wise cannot assume that I own the property without confirming with me and reject the claim based on that . so does one have to own a proprety in order to be a member ? reason 2 -The member and her child are not residing on the property .Due to the fact that my child is a minor she can’t reside at the property alone and it is registered under her name .As a legal guardian am doing everything on her behalf and as mentioned before the intention to make it a place of residence . reason 3 the matter/dispute relates to a member or executor – as mentioned before am acting in the capacity of guardian of the minor Plaintiff, and NOT in her capacity as Executrix in the deceased estate and the estate is wound up .See below emails from legal wise as proof that the claim was covered and my feedback , note that I have done everything they asked me to do and still rejected the claim .

Dear Ms P,

Kindly note that we require ownership to be changed to your daughter’s name.

You can do this at the municipal offices and once this is done we will be able to cover this matter as you will be acting as guardian of the child.

Kind regards,

Ownership was changed to my daughter’s name as requested below

Dear Ms P,

Kindly note that the matter was discussed with *** (manager) from our office.

He advised as follows regarding the referral:
He advised that you should produce proof that the estate is wound up and then we can refer to an attorney to proceed with the matter of eviction as you will not be able to evict in capacity of representative of the child, but once the estate is wound up and her child get the property then we can proceed.

I hope this is in order.

Kind regards,

A wound up letter was also provided as requested below

Dear Sir/Madam
This is to confirm that your LegalWise referral letter has been issued. Please refer to the attached document for further information.

Member advises that she is the Executrix in the Estate of her deceased boyfriend and she also further advised that the daughter born of the relationship is the beneficiary in the deceased estate. She further advised that the cousin of the deceased is refusing to vacate the immovable property of the ex boyfriend. Member requires legal representation to proceed against with an eviction application against the opposing party. (Kindly note that the member would be acting in the capacity of guardian of the minor Plaintiff, and NOT in her capacity as Executrix in the deceased estate).
