Charged R5500 penalty fee for moving out due to my small baby being allergic mould and carpet in the house

I moved in this Unit in Umgeni news in 2019 December. from 2021 i started noticing that there is mould starting to develop on the walls and ceiling and also whenever it rains the smell of the carpet and mould was unbearable. i tried getting a company to come and was the carpet because i thought maybe its just the normal carpet smell .I obviously cannot ask them to remove the carpet

nope! the issue started getting worse and worse, when you open the wardrobes the clothes smell of mould. 2021 i had a baby the mould issue was still there and i thought it is just stuffy then i developed of opening the windows and wardrobes.

my daughter started getting sick constant flue and chest infections i didn't realize that this would have such an effect on my baby. later last year when she was finally diagnosed of broncomonia, i then then i told the DR or our living condition in the house. he confirmed that the mould and the carpet smell could be the highest contributors to her condition. this was in December when she was sick again. on the 21st December i sent Genesis an email to give them a notice to move out by the 31st of February stating my reasons.

I had unfortunately just renewed my lease on the 30TH November not knowing that this place was life threatening for my daughter who is just 18 months.

The Genesis comes back to me with a letter stating that i need to pay R5 550 penalty fee because of canceling the lease. so 20 days of renewing this lease cost me more than 80% of my deposit.... i was told that this is because it is an inconvenience to the owner, how so when i have given more than 40 days notice to allow then to atleast look for a tenant, on top of that i was told that should they not find a tenant in time i will be liable to pay 3 months rent.

today Bennie from Genesis called me asking if i have made up my mind about leaving... only today they are thinking of advertising the property.. all this time nothing was being done meanwhile i have given them notice on the 21st December.

how do you do this more especially where there is a baby's life at stake. now they want to take all my money for deposit where will i go and stay with my baby, with which money?
