We rented from leapfrog in Pierre van Ryneveld and we were intimidated and **** to so that we have to move out. The property got sold during our lease period and the new owner and the police forced our doors open and took all our house keys without a court order. Then I got arrested the next week ********ly by the same lady with Lyttleton police at 01:00 in the morning after enter our house *******ly with the keys they stole. They said there was a warrant of arrest for me but I found out that it was not true and no proof of it. We phoned our estate agent from leapfrog who said she has nothing to do with us and the mandate was cancelled a few months ago. Leapfrogs manager contacted us and said there is no records of any of these lies on file and that they will help us. The same day she made plenty excuses for not wanting to help us anymore and I said its unacceptable what they are doing then she got an bad attitude towards us and never helped us anyway. We got threatened with our lives by a man who also *******ly entered the estate and was given access to our house by the apparent new owner aswell. We had to leave and are staying at a guest house for more than 2weeks now which we cant afford anymore. My wife is 6 months pregnant and we couldnt even take clothes at home and they dont want us to enter our own place. Last night I went to my house because its ridiculous what these people are doing and i saw that my WHOLE HOUSE IS EMPTY and all my belongings gone. How can people get away with all of this???? I have tried to go to the police for a month now to get assistance but its the same station that helped these ******* activities at my house. I run my business from home and couldn't work for a month now because of Leapfrog and my wife and baby cant take any more of this stress. Leapfrog will regret this when it goes to the high court. You guys have no conciounse at all.
RE: COMPLAINT LODGED WITH THE RENTAL HOUSING TRIBUNAL BY C COETZEE
We refer to your notice of 2 November 2017, as well as our email dated 6 November 2017.
We hereby confirm that:
1. Our mandate as renting agent was terminated on 19th September 2017 by the landlord, Mr and Mrs Lubisi;
2. The tenant, Mr S Roberts, is in breach of the agreement in so far as he did not pay the rent as contractually obliged;
3. A notice of cancellation was sent to the tenant on 10th August 2017 and a confirmation notice again on 23rd August 2017;
4. The tenant acknowledged in an email dated 6th September 2017 that he is in breach;
5. The tenant was refused access to the property on the 19th September 2017, after termination of our mandate by the landlord;
6. A Spoliation Application was brought on 20th September 2017 by the tenant;
7. The landlord then instructed Attorneys Ndumiso Voyi Inc, Ground Floor, Building 5, Midrand Business Park, Old Pretoria Main Road, Halfway House, Midrand, Midrand Business Park, Tel ***, Email: *** to deal with the matter and it is he whom is currently the attorney of record for the landlord.
8. Rental tribunal hearing 13 November- complainant/tenant failed to appear
We hereby deny that, we, as the renting agent:
1. Was directly or indirectly responsible or instrumental vis-à-vis –
1.1 The lockout;
1.2 Unauthorised entry by the owner and police officer;
1.3 Confiscation of the keys and changing of the locks;
1.4 Prohibiting access to the property; and
1.5 We are unaware of any valuables and cash on the property.
2. Had a mandate at the time of the incidents in 1.1 to 1.5 above.
However, since this matter was already dealt with by another court and there is currently court proceedings pending, we are respectfully of the opinion that the tribunal has no locus standi in this matter.
