<p>We met with William and Sue Verster to purchase a property. After jumping through many hoops, the banks finally approved our bond. Just then, William informed me that our offer to purchase expired 3 days ago and that they have accepted another offer.</p> <p> </p> <p>Details:</p> <p>We submitted an offer to purchase on a property. The expiry date to obtain bond approval was 21 February. ABSA, Standard Bank and FNB gave provisional approval and quotations for the bond before the expiry date and William Verster was informed of all the approvals by email and/or phone. At no time did William mention the expiry date, even during a call on 21 February. I made the call to arrange access to FNB's valuation officer. On 24 February we were informed that our offer expired and another offer was accepted. William went on to ignore our calls until we phoned from another number, and gave an incredibly arrogant and hostile reply.</p> <p> </p> <p>As per clause 2.1.3 in the Sales agreement:</p> <p>"Irrespective of anything to the contrary contained in this agreement, the loan as aforesaid shall be deemed to be granted within the period stipulated, should the financial institution to which application is made, issue a quotation and/or pre-agreement statements, or similar documents purporting to have the same effect and meaning, within the period stipulated in the clause."</p> <p> </p> <p>According to this clause, once a quotation has been received from any bank, the loan will be deemed granted and the offer to purchase becomes final.</p> <p> </p> <p>The agent could have simply offered us a Time Extension Agreement when I phoned William on 21 February, but he neglected to do so.</p>
