We agreed on full terms and conditions to the selling of our house with Leandra van Wyk from Leandra Real Estate. We fully informed her that we are busy with our Visa Applications and that we can only move out of our house by end Dec 2015. We also agreed on 4% commission. She is now forcing us and intimidating us to accept and sign an OTP with a higher commission percentage and with terms that does not fully agree to our discussions. The OTP specifies that we must move out of our property by end November 2015, even though we made it clear that we will only be moving to Australia end December 2015, seeing that the children must still complete the last term of school, and only on successful Visa applications. We also suspect that she made alterations to the mandate we signed. We can both confirm that we signed for 4% commission. We never received a copy, and upon querying the higher commission, received an electronic copy with 6.84% commission. Leandra also orally informed and acknowledged that the mandate is only a 'permission to market property form'. The fine print states it to be a mandate. This is ********** and ********* business behavior. Be careful to use this Agency.

I endeavour to ascertain the best possible terms for each and every transaction, therefore I reduced my agent’s commission from 7.98% to 6.84%. In an effort to ensure transparency and to give you a guarantee, the commission percentage was reduced to writing in the form of a mandate agreement and subsequently signed by all parties. I ensured that you understood all terms and conditions of the OTP, especially the clause relating to when you would need to vacate the property in light of your emigration to Australia.
In light of this unfortunate situation I give you my 100% guarantee that all dealings with your matter was done so on a bona fide basis. My voracious desire for justice and fairness has even lead me to timeously reply to your EAAB claim as I am not surreptitious about any of my dealings.
