Complaint against Le Morgan – Layby Refund Refusal

I purchased Le Morgan pots on a layby and paid several instalments. After careful consideration and a change of mind, I contacted Le Morgan to cancel my layby order. I was shocked to be told that I am not eligible for a refund, and that instead I must choose another product.

I do not want an alternative product . I want my money refunded.

At no point was I informed that refunds are not allowed on cancelled layby orders. There were no written terms and conditions provided to me, no paperwork signed, and no policy explained. The entire transaction was handled over the phone, and I never signed or agreed to any clause stating that refunds would not be issued.

As a consumer, I have the right to cancel a layby agreement and request a refund. The claim that Le Morgan “does not have refund facilities” is unacceptable and unreasonable. Most retailers in South Africa refund customers when a layby is cancelled. Saying they cannot refund raises serious concerns does the business not have a bank account?

This practice appears to be against the South African Consumer Protection Act, which protects consumers from unfair, undisclosed, and misleading terms. You cannot enforce conditions that were never disclosed or agreed to.

I feel extremely frustrated and taken advantage of. Le Morgan is forcing me to accept a product I do not want instead of returning my own money, which is unfair and ********.

I am requesting that Le Morgan contact me urgently and process my full refund. I want my money back nothing else.

Where exactly did I sign or agree that refunds are not allowed?
