Deposit taken and job quoted not done

Paid R28000 to Klerkie Lourens as a deposit for cupboard changes that need to be done in my Mother's new home. Since the payment was made, he is yet to make an appearance and he either ignores our calls or his phone is off. The only assumption I can make is that he has spent the money and is not able or willing to come clean and complete the work quoted. I have been to the police and this does not constitute as theft and they will not open a police docket as the money was paid over willingly. We must now take the legal route
