Negligence

My vehicle, a 2013 VW Golf 1.4 TSI, was taken for it’s 105,000 KM annual service to Kohler Motors Claremont (A Bosch Service Franchise), as the vehicles VW maintenance plan expired at 90,000 KM.

The vehicle was quoted for a 105,000 KM service. This entailed replacing / changing the Engine Oil, Oil Filter, Engine Cleaner, Spark Plugs, Air Filter, Cabin Filter, Antifreeze and Brake Fluid

In addition to the above the following was identified for replacement X1 Brake Light Bulb X4 Pencil Coils

The above quote was accepted and the work was carried out and paid for. Upon receiving the vehicle back from the garage and being driven for less than 2KM the vehicle engine would lose power and be unresponsive with a Start/Stop error message coming up on the dash.

The vehicle was towed back to Kohler Motors for inspection. Upon inspection, it was identified that the throttle body part of the vehicle had accumulated some dirt which was cleaned. Once again taking receipt of the vehicle and being driven for less than 2KM’s the vehicle cut out again.

The vehicle was towed back again to Kohler Motors for inspection. The throttle body has an electronic component which was identified as being damaged / unprogrammable and quoted on to be replaced. My complaint is two fold –

1.) The throttle body was not identified as being faulty during the service inspection nor could it have been as had it been faulty before one would not have been able to drive the vehicle. 2.) The quote for the throttle body part was 30% higher than the original part retails for at a VW dealership.

It is evident that the throttle body was damaged whilst the vehicle was in the care of Kohler Motors and I should not be covering the cost of the repairs. It is the position of Kohler Motors that the throttle body was never touched during the original service and therefore they cannot be held liable for it.
