Wendy house construction

On November 21st 2017, I found a add on OLX that this company in Vereeniging can help me with the construction of a 6 x 4m Wendy. I corresponded with the gentleman (Tony Mafuru id number 790 ********** 082) who's number appeared on the add and he confirmed that he will be able to deliver as we discussed - I needed to pay him R4500.00 as a deposit which I then did on the 21st November 2017 at 10:20. as the date that was agreed upon for delivery arrived Tony did not Deliver as promised - we then phoned to confirm what the problem is and Tony said that the person supplying the material passed away. I asked him to pay back my Deposit and he then told us that he does not have the money anymore and he doesn't have fund to repay me, on the 30th of November 2017 he went to write a affidavit at the Vereeniging police station that states he will need time to get the fund and that he will pay back my deposit on the 27th December 2017 IN FULL. we gave him grace on the 27th my money was still not paid in and he still had an excuse of the company that doesn't have funds. On the 28th of December 2017 went to court to get a Letter of Demand (S29) which I then sent to the Sherriff department in Vereeniging on the 8th of January 2018 they told me that I must pay in a handling fee for them to serve the papers to Kholton Construction and marketing services (Tony Marufu). Sherriff department Vereeniging did not give any feedback as to whether or not the papers was served to above mentioned company or not - the company is aware of the paper as Tony Marufu phoned us the week of the 15th January 2018 asking us if we are kidding around because he didn't receive any paper yet stating that he has 14 days to pay back my money. I'm asking for help please I do not know what to do anymore, I can supply you with the necessary documentation and phone recordings in which everything that is stated above is documented.
