JUST STEEL a.k.a JUST "*****"

Despite both our own and our attorneys letters of demand for specific performance - to either refund us our money or deliver the cabinets, Peter (the CEO/ owner) seems to operate with (perceived) impunity, hiding behind deviously crafted T's & C's that reflect ignorance of contract law by attempting to allow himself and his business the freedom to do as he wishes, with no liability to himself or the company! He reiterates by way of response to our demands that his company's T's & C's state that any person or business that posts negative comments about his business on a social media platform will forfeit their deposit as a result of damages to their reputation! This is quite remarkable. What reputation?

The general principle of freedom of contract must be balanced against public policy concerns that a party who freely undertakes a binding contractual obligation should not be equally free to absolve itself from its duty to perform.

In terms of Consumer Rights as contained in the CPA, there exists a "fairness" test. Any term which causes "a significant imbalance" in the parties' respective positions, to the detriment of the consumer and in a way which is contrary to the requirement of good faith, will be regarded as "unfair"."

If a term is considered to be unfair, it will not be binding on the consumer, who can treat it as struck out of the contract. The remainder of the contract will stand if it is capable of doing so according to the usual principles of severability.

If one looks at the number of posts since the start of January 2018 to date, it is evident that our experience is not an exception, but is the norm. It is thus clear to me that JUST STEEL has extremely serious problems and no respect for consumer rights.

All affected (would-be) customers should stand together. Let us determine what the total value is of payments made to Just Steel for goods that have not been supp**** by them, and post this on HelloPeter. Name them and shame them! We can then also consider a class action against this ************, *********, shameless, ************* and dishonest company.

I am now going to lay an official complaint against Just Steel with the Consumer Council. I suggest that all affected businesses or individuals, do the same. Just Steel (aka "JUST *****") is a disgrace!
