Bad Driving & Negligence

On the 12th Of March 2019, I had met with an accident with Joshua Tree Landscapes. I had been exiting my office park in La Lucia, Umhlanga, when one of their vehicles had smashed into mine. The cause of the accident was due to the fact of the driver was distracted by sticking his head out the window and conversating with a pedestrian that had been walking across the traffic circle within the office park:

- The driver had then driven into the oncoming lane of which I had been on and drove into me, despite the fact that I had honked my hooter multiple times and had even brought my vehicle to a standstill.

- The accident had been reported to SAPS, as well as Joshua Tree Landscapes. Joshua Tree Landscapes have since had their insurance broker contact me requesting documentation (ID, License, Pictures & sketches of the accident scene, No-Claim Bonus Letter & Vehicle Repair Quotes), which had been provided by me.

- I had been contacted for the second time by their Insurance Broker & Attornies requesting documentation of which I had already provided.

-I had also been contacted via email by Joshua Tree Landscape's Insurance/Attorney stating that they are unable to respond with a settlement for the damages of my vehicle, due to Joshua Tree Landscapes not giving the go ahead. But instead, I am being held responsible for the accident, as they are placing the blame on me and making this seem as if I was the cause of the accident; and I quote: "At this stage, our client holds you responsible for the damages suffered to his car, as, according to him, you were driving in the middle of the road."

*This is not the case as I have evidence/pictures & witnesses that prove that this had been Joshua Tree Landscape's fault, & not mine!
