Horrible communication and lack of respect for the customers. No etiquette followed
The suspensive condition for my bond listed my bond due date as 25 September 2022. The date has passed but transfer of ownership has not happened and I have not received confirmation of occupants willingness to vacate premises. I also recently discovered that the transfer date on the sales agreement was listed as 23 November 2023 despite the sales agreement having been signed on 25 August 2022 and me having been advised by the agent verbally and via Whatsapp text that everything would be done by December. This was because I had mentioned to the agent that my reason for wanting to purchase a property was because my lease was ending on 31 October 2022 and I did not want to extend my lease due to an upcoming rent increase. Based on Emmanuel from Chris Bernard Properties' advise, I extended my lease until 31 November 2022 only to be advised that the sellers have nowhere to go and I was advised to extend my lease until 31 December so that they sellers will pay me an occupational interest rate of R8000 while they live there. I signed the addendum to the sales agreement but never received the signed copy back nor did I receive written confirmation from the sellers that they would vacate the premises by 31 January 2023. Instead they further delayed the transfer process by paying the rates and levies in 4 installments.
Now Emmanuel is telling me that he never advised me that things would be done by December 2022 despite me having the text message from him and the rental agency where I live have already found tenants who will occupy the place by 1 February 2023 and I am left in a limbo because not only do I have no confirmation that the transfer of property will complete on time but I also have no confirmation that they occupants are even willing to vacate the premises after the transfer of property PLUS the sales agreement lists the transfer date as 25 November 2023. Emmanuel from Chris Bernard Properties called me two days ago and based on our conversation, what he is being told by the Jardim Bekker Attorneys and what I am being told by them are two different things. He did however say that he would speak to the tenants about moving and waiving occupational interest being paid by me to the tenant. He also mentioned that transfer date listed on the sales agreement was a typo but when I asked him to put it in writing he started giving me the run around and asking me to trust him. I sent him, Chris Bernard Properties, Jardim Bekker Attorneys and the sellers an email to find out when I could come get the key and was advised by Lizette from Jardim Bekker attorneys that I cant get the key until transfer of ownership happens. This is despite the sellers having sent me an email stating that they would definitely be moving by 31 January 2023. I have been asking for the Letter of undertaking from FLISP and the signed addendum to the sales agreement whereby both parties signed and the sellers confirmed that they would be leaving by 31 January 2023 and was sent the unsigned version by Jardim Bekker Attorneys. It seems like they aren't doing anything and I am being given the run around and I am worried that come end of the month I won't have a place to stay because I already put in my notice at my current place of residence and they already have a tenant who is moving in on 1 February 2023. I was initially supposed to move out on 31 October 2022 then was advised by the broker and conveyencers to extend my lease until 1 December 2022 then I was advised again by them to extend my lease until 31 January 2023.
On 17 January 2023, I spoke to the seller directly after having consulted with Nathier Jassiem from MN Jassiem & Associates. We were under the impression that the seller may not have the funds to pay for the rates and levies so I contacted him to advise him about bridging financing. The seller advised that the lawyers **** and that he had already paid everything around November and he had only done it in 2 payments. He also advised that the Jardim Bekker Attorneys had advised him beginning of December that the officers were closed and that’s why they could not do anything. Omer (the seller) also advised on the phone that he would definitely be moving by the 31st and he sent me a Whatsapp message confirming this. On multiple occasions, I asked the Jardim Bekker Attorneys for the signed copy of the addendum to the sales agreement depicting that the sellers would move by 31 January 2023 and was sent a blank document by Lizette Bekker. Until now I have not received these documents from them and today Emmanuel Purazi from Chris Bernard Properties advised that the sellers told him they will only move on the 1st. This is after I have booked a moving company for the 1st, scheduled the fibre installation for the 1st and also scheduled the delivery of my fridge and stove for the 1st because I was under the impression that I would be moving in on the 31st after receiving the keys on the 31st based on the information presented to me by the seller and Emmanuel. Everytime I ask Jardim Bekker Attorneys for information, I get no response unless I start threatening them with legal action.
It is now 1 February 2023 and it has been almost 6 months since we commenced the transfer process. Emmanuel advised via call that the transfer date of 25 November 2023 was a typo but declined to send me that via text. These delays that occured as a result of malpractice have resulted in me ending up homeless.
Luckily, Emmanuel was able to assist me and get me into the keys to the place on 1 February 2023 but the lawyers did not even apologise. Nothing. Horrible service. DO NOT USE THEM
