IWYZE INSURANCE REFUSED EXTENSION OF CAR RENTAL FOLLOWING TWO MONTHS DELAY TO COMMENCE CAR REPAIRS

Following the accident car on 11 November 2023, on 10 January 2024, Old Mutual Iwyze Insurance refused to extend the car rental despite the unprecedented two months delay to commence car repairs. The delays occurred due to the long agonising assessment process and the unjustifiable unwillingness to repair major damages. On one hand, Iwyze insurance is responsible for the abnormal delays and on the other hand, it has refused to extend car rental and thus compelled the client to incur car rental costs. By extension, Iwyze Insurance has refused to take liability for the unprecedented delay. In as much as it is using its policy to refuse the extension of the car rental but such policy does not cater for an abnormal situation of two months delay before the commencement of repairs. Therefore, the policy justification is not applicable because it operates outside the abnormal situation where Iwyze Insurance delayed the commencement for an extended period of 60 days from the day of the accident on 11 November 2023 until the second authorisation on 11 January 2024. The agonising 60 days waiting and the refusal of Iwyze Insurance to extend car rental costs has impacted negatively on my finances and created unbearable severe strain on my health condition. Currently, I am in consultation with the doctors to determine the extent and severity of my condition in the aftermath of the unbearable pain I have been subjected to since 11 November 2023. Also, at this stage it is not clear whether the authorisation will cover the replacement of the damaged Radiator, Steering Knuckles, CTR & Rear Trim, Wheels and Shock Absorbers highlighted in the assessment report issued in November 2023 (see attached two assessments reports). In essence, the unprecedented 60 days waiting period before the commencement of repairs is indicative of the breach of contractual obligation by Iwyze Insurance. The Iwyze Insurance should be held accountable for the refusal to take responsibility for the unreasonable 60 day waiting by providing the car rental among other things.

This is likely to stand out as one of the worst case scenarios in the history of South African Car Insurance companies pertaining to the abdication of mandated contractual obligations to the detrimental of the client. Sincerely, Dr JJ Klaas (PhD Cambridge UK) Email: ***
