Complaint against IWYZE

Complaint against IWYZE

2020 was the worst year of my life. Everything happened so fast. Losing my husband and having a child who was going in and out of the hospital for operations, covid19 lockdowns, having to deal with the insurance that was just determined to make my life miserable. I just couldn't take anything that had to do with my husband. It felt like there was no time to digest on what happened Going back to 2020 after my late husband was in the accident and we were insured by Iwyze, I was not worried much about my car, I had other stuff to be worried about like how to burry my husband and pay for the rent and medical bills of my son who was critical from the same accident that took the life of his father and being locked up in the house alone with an injured child and no visits as the country was on lockdown I never thought that a big company like Iwyze can unfairly treat their customers as they did to me. I sent my claim immediately after burying my husband as I was compressively covered by them Iwyze just from the beginning of submitting my claim, showed me that they were looking for the ways of not paying. When the accident happened, my husband was traveling from viewing the park where we were going to take the kids too the next weekend which was supposed to be his birthday, which ended up being his burial weekend. He was traveling with our son and our nephew, seven and four year olds at the time There was no witness who saw what happened when the truck (COCACOLA collided head-on with our Chevrolet Cruze. As I followed up on my claim, I was told by Iwyze assessor that the truck had dashboard cameras and that is what will help to show what happened. The information about the dashboard was also given to the investigating office, but the camera was never shared and no one is saying anything about what happened to the dashboard camera. Iwyze only went to the accident scene to check on the car 3 weeks after the accident. They claim they spoke to the truck driver and they used the testimony from the truck driver. The investigating officers are still searching for the driver as he was supposed to report to give the statement at the police station and he never showed up. In November 2022 when I called the investigators, I was told that they are still looking for him. It raises questions on how IWYZE got hold of him while the state is still looking for the guy I contacted the Ombudsman, and the Ombudsman wanted me to tell them what do I think happened, although I have told them I was not in the car, I can only use my assumptions in which I don’t think we needed to work on assumptions if there was a dashboard camera. At the end the Ombudsman went with IWYZE version. I submitted to them the investigation officers contact details, the police station contacts details, but the person I was dealing with from the Ombudsman told me my file was closed and remain closed. He also mentioned that the fact that the decision was not on my favour does not mean that the decision was not fair, and also, they do not procure evidence for any party. I do not understand when they say they do not do investigations, how do they get to their conclusion. I also think that it is only fair that Ombudsman ask for what they need in order to make their work easy. If I knew I would have asked for the docket, and any other documents that could have made the case be treated fai to both parties. The email that I received suggested that I look for the lawyers to pursue the case as this does not have to end with the Ombudsman's decision. I ran to the Ombudsman because I felt that they were going to fairly look at my case and not just take the word from the insurer or myself without investigating our story. Going to the lawyers will mean paying an hourly consultation fee, I have already paid the bank the monies that my car was owing. The insure sent me to the Ombudsman, the ombudsman is advising me to get a private lawyer, I felt lost and confused When one takes insurance, it is for the reasons to be covered against unforeseen incidents like this one and to have peace of mind. Going to the lawyers to get you covered it's not fair to clients while you think you are covered.

IWYZE claim my husband acted with GROSS NEGLIGENCE, hence they declined my claim. I just want to know exactly how they came to such a conclusion. He who alleges must prove. Please take note of the following: Iwyze went to evaluate the car 3 weeks after the accident occurred, they went to the accident scene 3 weeks after the accident or longer than that, I have that communication when IWYZE consultant wanted me to go to the accident scene with him Iwyze Is unable to share the dashbordCam they claim to have. Iwyze claim to have found and interviewed the truck driver (state confirmed they are unable to find this particular driver) , but cannot share the interview with anyone. Iwyze records their telephone conversations. Omburdsman on the other hand took a decision without requesting Iwyze report or deshCam video showing that my husband was negligent or at wrong. Beside IWYZE, my husband's work had their assessor to also do their investigations and their report differs from IWYZE. They were in contact with the police station, they were in contact with the police investigator who was at the accident scene, they requested for the docket from the police station in order to get to their conclusion, they also requested for the postmortem , on the other hand IWYZE only have the claims of speaking to the driver of the other car and send me their drawings or scratches of their assumptions. If they have the proof I request to see the documents and Webcam.
