I moved out of a unit at Vuja De into a bachelor unit at the same building

I moved out of a unit at Vuja De into a bachelor unit at the same building. Before I moved, I asked the building manager on 2 occasions on how to move out. She did not respond. After I moved out I tried to claim my deposit but I did not get the refund as I was informed that I absconded the unit I moved out of. I have also been charged 1450 on my final statement; 1200 repainting the wall and 250 for a shower curtain. When I moved into that unit in September 2023, no inspection was done after the previous tenant moved, the room was not clean and the previous tenants belongings (bed, carpet) were still in the room. I then experienced a bed bug infestation after because of the previous tenants belongs, this shows that the unit was never cleaned or inspected. When I left the unit there was a shower curtain in place, the lady I was sharing the unit with was still in the unit when I left so why am I to pay 250 for a shower curtain.

Dear Wadzanayi,

We would like to take this opportunity to provide further clarity regarding your recent inquiry about the refund of your deposit and the associated maintenance charges.

After reviewing your tenancy record, please note that the unit you previously occupied was registered under a different leaseholder. As per the terms and conditions outlined in that lease agreement, the leaseholder is required to provide a formal notice of termination prior to vacating the premises. This notice enables us to process the lease conclusion correctly and refund any applicable deposits.

In instances where a tenant vacates the unit without the required notice of termination, the departure is classified as absconding in accordance with the lease provisions. Unfortunately, such circumstances carry associated penalties, which may affect the refund of the deposit.

Should the leaseholder have any written communication to formally terminate the lease, kindly request them to submit the relevant notice or supporting communication. Once you have obtained this, please forward the screenshots or documentation to ***, and our team will gladly review the case and make any necessary adjustments on our end.

With regard to the maintenance charges, please be advised that since the unit was shared accommodation, both you and your co-tenant were billed for the painting and replacement of the shower curtain. These items fall under the category of shared or common areas within the unit, and as such, both occupants share equal responsibility for their upkeep and restoration at the end of the tenancy.

Furthermore, we would like to gently remind you that at the commencement of any tenancy, it is the tenant’s partial responsibility to conduct an in-inspection of the unit. Any existing defects, maintenance issues, or damages identified during this inspection should be promptly reported to our building management team. This process ensures that all matters are documented and resolved in a timely manner, preventing any potential disputes at the end of the lease period.

We truly appreciate your understanding and cooperation in this matter. Please rest assured that our intention is to ensure fairness and transparency in all aspects of your tenancy. Should you have any further questions or require assistance with documentation, please do not hesitate to reach out to us at *** or contact our office directly during business hours.

Sincerely,
Ithemba Property
