Complaint about Ithemba refusing to pay back my deposit
I am absolutely not happy about the way they **** people money, they milk you until the blood comes out. Right now my lease has expired and they ordered me to vacate the place before 12 midday on th 28th of Feb . I did exactly that because I did not want stories when it comes to my deposit being sent back to me. Now they are charging me a late fee when we all knew my lease is expring end of Feb. I am well within my right to get my deposit back. The Consumer Protection Act no.68 0t 2008 says the Land must ask the tenant 40 to 80 business days before expirry date of the lease to gauge the interest of the tenant to renew the lease, they did not do that, therefore I need my money back tomorrow. I cannot be penalized for the expiring date of my lease. It came to an end. If you want the place to stay, do not go to Ithemba property because they are a ****. Absoletely disgusting!!! I ahve lost my job but they still milking me my money.

Please refer to the Notice to Vacate Form that you signed on 17th February 2025, specifically Clause 1 and Clause 10 of the terms and conditions. By signing, you confirmed that you had read and understood these terms, which clearly state that notice to vacate must be submitted no later than the 4th of the month. However, we only received your email indicating your intention to vacate on 12th February 2025, which was past the deadline.
According to the lease agreement, tenants are required to provide at least 20 business days’ notice, which was not met in your case.
Additionally, in your communication with our customer service team (Ticket #249577), you were informed about the penalty due to the late notice, and you acknowledged your understanding of the situation, indicating that you would not be able to cover the required penalty due to your circumstances.
As per the lease agreement, even upon the expiration of your initial lease term, tenants must provide the landlord with 20 business days' notice if they do not wish to continue the lease. Failure to do so results in an automatic transition to a Month-to-Month lease.
At Ithemba, we follow all procedures as outlined in the lease agreement, and it is essential for all tenants to carefully read and understand the terms and conditions before signing any legal documents.
