Poor management - non payment of salary

This company does not follow Basic conditions of employment. Section 41 states UPON termination of employment all monies owed are to be paid. Well my hubby finished a week ago and we are still waiting for his leave days and 2days of work to be paid out. Their HR told him he can do just what he likes and take them to the ccma. Who do they think they are to take things above the law
