Worst Bus to travel by with selfish travel Terms and Conditions
I'm using this platform to air out the dirty laundry of the Intercape Bus Company.
Intercape has refused to reimburse me the cost of the luggage that I've lost when I was travelling using their bus from Johannesburg to Port Elizabeth.
According to Intercape drivers the company is very much aware of the incidents of that nature with their buses where passengers would report lost luggages when traveling with their buses, and now they are using their company disclaimers (terms and conditions) against me to avoid the reimbur*****t.
The driver(s) were driving by 20km per hour when the incident that resulted to the loss my luggage took place and according to them it is their company instruction to drive by 20km per hour in that area because of the accident that claimed a life of a passenger that transpired last year with one of their buses in that area (near Grahamstown).
The driver mentioned that he noticed that the lock on their caravan was removed on one of their stops, but according to the policy of Intercape they are not allowed to stop, they just need to keep driving. Their driver also mentioned that their company policy does not allow them to get out of the bus and attend an intruder/ ******** even if they see one cause should anything happen to the driver's Intercape will not be liable or be at fault for anything.
And last but not least, Intercape had a nerve of creating an expectation for the reimbur*****t by asking me to list the items that were inside my luggage and their total value, only to give me an apology and hide their selfish backs with their company terms and conditions of travel.
Below is what they have sent to me:

As per our telephonic conversation, kindly find the below for your attention.
RE: INTERCAPE FERREIRA MAINLINER (PTY) LTD (“INTERCAPE”) -
We refer to your claim for compensation in respect of your luggage.
We have had an opportunity to investigate this matter . However, we wish to remind you of our relevant terms and conditions of travel.
That:
INTERCAPE is not liable, to the fullest extent permissible at law, for any loss, damage, death or injury whatsoever and howsoever arising, including but not limited to, claims arising from the transportation or non-transportation of persons or goods or loss or damage to passengers’ luggage, goods, hand luggage, personal effects, personal safety, bodily injury, death or loss of income or profits, and the passenger in accepting the ticket indemnifies INTERCAPE to the fullest extent permissible at law against any claims whatsoever and howsoever arising whether direct, indirect or consequential damages, and whether existing, immediate or future loss, damages, death or injury, including any liability that may arise at common law, statutory law, on an equitable basis, natural law, international law, customary law, indigenous law or in terms of any other law or international instrument applicable in any country serviced by INTERCAPE.
3.1. INTERCAPE does not provide any insurance cover for its passengers, their property or luggage. All passengers should ensure that they are adequately insured.
While you have provided us with an inventory listing the items that is lost, we have no proof of the actual and currently value of the items, the large majority of which presumably are not new in any event and can therefore not be estimated at their original prices.
In all circumstances, INTERCAPE does not have a legal obligation to make good any loss that you may have suffered because of the lost luggage. This particularly so where you have chosen to:
5.1. Carry valuable items on your person; and/or
5.2. Did not obtain insurance cover in respect of your luggage ( or at the very least, in respect of valuable items)
We trust you accept our apology and use our services again.
