Formal Complaint – Gross Negligence, Passenger Endangerment & Operational Misconduct by Intercape

This serves as a formal complaint regarding the appalling and negligent treatment I experienced on my scheduled 20:00 Intercape departure (arrival 06:20). Upon boarding, we were informed that the bus was already full because passengers who were NOT allocated to this specific service had been allowed to occupy booked seats. This indicates a serious failure in passenger manifest control and operational management. Instead of resolving the situation internally and professionally, the fleet controller in Johannesburg, Themba, together with the drivers, instructed us — legitimate, ticketed passengers — to board the bus and ask other passengers to voluntarily disembark so that we could take our rightful seats. This instruction was reckless, irresponsible, and wholly inappropriate. It is not the duty of paying customers to enforce your booking system, manage overbooking errors, or negotiate with other passengers due to your operational failures. As expected, no passengers exited the vehicle. As a result, approximately 30 ticketed passengers, including women and minor children, were left stranded on a pavement at night for approximately 1 hour and 30 minutes. We were later told that another bus would be arranged due to an alleged “breakdown,” yet there was no consistent explanation, no structured communication, and no visible accountability from Intercape staff. This situation raises serious concerns regarding: • Gross operational negligence • Failure of duty of care toward passengers • Passenger endangerment by leaving women and children exposed at night • Misrepresentation of confirmed ticket allocations • Emotional distress and reputational damage • Complete absence of crisis management protocols Leaving paying passengers unattended on a public pavement at night constitutes a clear breach of basic safety obligations and reasonable duty of care expected from a national transport operator. The conduct of staff on duty was dismissive, disorganised, and unprofessional. No structured apology, incident report, or immediate resolution plan was provided. I have full recordings of the incident, including: The instructions given to passengers to beg others to disembark The communication failures The delay and lack of accountability These recordings will be made available should this matter require escalation. I hereby demand: A formal written apology from Intercape management. A detailed written explanation of how passengers not allocated to the service were permitted to board. Confirmation of disciplinary or corrective steps taken against responsible staff. Appropriate compensation for distress, inconvenience, and safety risk exposure. A clear outline of corrective operational measures to prevent recurrence. Should this matter not be addressed adequately and urgently, I will proceed with escalation through the relevant consumer protection and transport regulatory authorities, and pursue all available remedies. This experience was unacceptable, negligent, and in clear disregard of passenger safety and dignity. I await your urgent written response.
